Minutes of Provincial Revenue Service and Recruitment Procedure (Amendment-1998)

1.
1.1 This amended Minutes on Provincial Revenue Service will come into effect from 15th September, 1998.
1.2 The 'specified' dated of this minutes means the day of 15th September, 1998.
1.3 The procedure relating to recruitments to Provincial Revenue Service being in operation to date, hereby repeal with effect from 14th September, 1998, and this amended recruitment procedure will be operated from 15.09.1998, superseding all the procedure existed to the date.
1.4 This minutes to be known and cited as 'Provincial Revenue Service Minutes and recruitment procedure of North Central Province.
1.5 The TermHon. Governor, hereinafter referred in this Minutes, means Honourable Governor of North Central Province.
1.6 The term Provincial Public Service Commission, hereinafter referred in this Minutes means Provincial Public Service Commission of North Central Province.
1.7 'Provincial Revenue Department' hereinafter referred in this Minutes means North Central Provincial Revenue Department.
1.8 'Provincial Revenue Service' in this Minutes means Provincial Revenue Service of North Central Provincial Council.

2. Structure :
2.1 The Head of the Provincial Revenue Department shall be an officer absorbed to the post of 'Provincial Revenue Commissioner' interim of section 3.1 in this minutes or an officer appointed in terms of section 5,3 in the Minutes.
2.2 The Provincial Revenue Service shall consist of officers, appointed to posts as described in the schedule hereto, from and out of any category of classes and grades, described below.
2.2.1 Annual Salary scale of the Provincial Revenue Commissioners(T-7-l)Rs. 179,520-- 10X 8,160- 261,120

Efficiency Bar:

Class II, Grade II Prior to level of Rs. 92,100 Departmental Efficiency Bar Examination specified in appendix 1 (c).

In case of a probable revision of salaries of Class II, Grade II, the efficiency Bar Examination level aforesaid, shall be varied accordingly.

2.3 The above mentioned salary scales are subjected to revisions on the orders of Hon. Governor or Provincial Public Service - Commission.
2.4 The above mentioned consolidated cadre may vary and revise on service requirements for the time being.

3. Absorption :
3.1 All those officers, who have been appointed by Provincial Public Service Commission, to classes and grades referred in section 2.2.2 above as a cadre in Provincial Revenue Service, in respect of Provincial Revenue Commissioner's Department by the date of 15th September, 1998, are considered to be absorbed, to Provincial Revenue Service.
3.2 Duly appointed officers to grade II of Class II (Assessors of Grade 11), shall be absorbed to Class II, Grade II in the Provincial Revenue Service and, those duly appointed officers will qualify to receive annual salary scheme provided in section 2.2.2 above and the present salary step, they draw.
However, unless otherwise provided, in case of their failing to get through the Efficiency Bar Examination, as prescribed in appendix 1 (c), before the annual salary scale of Rs. 92,100 payments of salary increments in respect of that scale and the above shall be in terms of paragraph 15 in Chapter II of establishment code of Democratic Socialist Republic of Sri Lanka.
3.3 Steps will be taken to absorb to post of Tax Officers of Class III, Grade II from the cadre of officers who have served at. least for four (4) years continuously by the day of operation of this minutes, in the Provincial Revenue Department and been confirmed in their posts in State/Provincial Public Service and being passes G.C.E. (Advance Level) ' Examination with 2 credit passes and Four subjects in one and the same sitting.
However this particular absorption scheme shall be limited to fill only the 25% of the posts being fallen vacant, at the commencement and not thereafter
This absorption will be...............on a certificate issued by the Head of Department with regard to the efficiency of the officer.

4. Recruitment Scheme:
4.1 Class III, Grade 0 - Tax Officers Open Recruitment Open recruitment will be from and among the under mentioned eligible candidates, who qualify from a written test and an interview to be held, and on - the basis of their results of the said Examination. (a) A Graduate from a recognized University or (b) An Attorney-at-Law or (c) Should have passed Licentiate Examination of Chartered Accountants or (d) Should have passed Intermediate Examination of Diploma in Accountancy or Intermediate Examination in Commerce, conducted by Sri Lanka Technical College, or (e) Should have passed parts I, II & III of Chartered Institute of Management Accountants (C.I.M.A.) U.K. United Kingdom. if) Should have passed parts I, II & III of A.C.C.A. (U.K.), United Kingdom. Only those who have a permanent residency in North Central Province, at least for last 3 years, continuously as at the closing date of application and between the age group of 18-45 years are eligible to apply for these posts.
4.2 Appointing to Permanent Service :
4.2.1 Appointments to selected candidates in terms of section 4.1 above, shall be............on the probation for a period of three years (The appointees are required to pass official language proficiency Examination and Those who pass Language Proficiency and qualifying Examination, prescribed in appendix 1 (a) would be appointed to permanent Service, at the end of 3 years period.
4.2.2 Services of the direct recruits, who fails at qualifying Examination during a period of 3 years, will be terminated.
4.3 The selected-candidates in terms of section 3.3 will be deployed on acting basis in Class III, Grade II. They are required to pass and qualify from qualifying Examination, prescribed in appendix 1 (a)within a period of 3 years. They officers, fail to obtain more than 50% mark on this qualifying examination will be returned to posts of clerk, at the end of the aforesaid, period of 3 years.
4.3.1 Training will be in accordance with section 6.4.
4.4 Class III, Grade I (Senior Tax Officers) (a) Officers in the Class III, Grade II, who completes 5 years continuous and satisfactory service in the Provincial Revenue Service and Pass the Qualifying Examination. Prescribed in part 1A in the appendix will be promoted to class III, Grade I in Provincial Revenue Service. (b) The officers appointed to Class III Grade I required to pass the qualifying Examination, prescribed in section I(B) in appendix before confirmation in their post, upon completion of the said examination, they will be awarded two extra salary increments.
4.5
4.5.1 Class II, Grade II (Provincial Assessors) 50% out of the vacancies will be filled from the Class HI, Grade I Officers in the Seniority and merits on completing qualifying Examination, prescribed in section 1(B)of appendix. Merits in this connection will be determined on the results of an Examination held, in conformity with Public Administration Circular No. 15/90.
4.5.2 The balance 50% of the vacancies should fill on the results of the written test prescribed in chapter 2(B) in the appendix, from the following eligible candidates, who proves three years permanent residing in the North Central Province, as at the date of application. (Candidates who qualify from the written test will be called for an interview). (a) I. Candidates should posses a degree from a recognized university in state finance, public administration, business management, mathematics, valuation and Taxation, a degree with Economics as a subject a degree of Bachelor of commerce, both be in first class honors or in second class Upper or Equivalent qualification recognized by the Government, and II. Should have a credit pass in English Language at G. C. E. (O/L) Examination, and III. Age should not be less than 18 years and not more than 45 years as at the closing date of applications.
4.5.3 Officers, with qualifications in section 4.5.2 and 4.5.2(A) aforesaid, already being employed for a period not less than 3 years in the North Central Province Provincial Public Service also are eligible to apply for the written test, prescribed in section 4,5.2 above. But they need not passes 1st class or 2nd class upper passes in their degrees, age limit also are not applicable for them.
4.5.4 The officers appointed to Class II, Grade II are required to qualify from qualifying Examination, prescribed in chapter IŠ, in the appendix, before their confirmation in posts. Acting officers will be made permanent in their posts, upon completion of qualifying Examination and passing of official language proficiency tests within 3 years prescribed by establishment code for the purpose of confirmation in their posts. Acting officers are required to pass this Examination with in 2 years, from the date of first appointment.
4.5.5 Officers in the Class II, Grade II will receive two extra salary increments, upon completion of examination, prescribed in chapter I(c), in the appendix.
4.6 Class II, Grade I (Provincial Senior Assessors) officers in the Class II, Grade II, who pass the qualifying Examination of that grade and complete Six (6) years satisfactory service, will be promoted to Class II, Grade I, on the basis of their Seniority and merits of the service.

5. Class One - (Deputy Provincial Revenue Commissioner)
5.1 Deputy Provincial Revenue Commissioner will be remitted by promotions of Class II,, Grade I officers on their seniority and merits basis, in the Provincial Revenue Service.
5.2 On an occasion of non-availability of suitable officer to promote Class One, from the category of Class II, Grade requirements may be done from Class I Inland Revenue Service Officers, who has been fully released from that service or recruitment may be done on contract basis from the category of retired officers from Class I retired officers from Inland Revenue Service.
5.3 Provincial Revenue Commissioner : Shall be appointed, when fallen vacant by following under mentioned scheme of recruitment.
(a) Be a Class I officer in Provincial Revenue Service.
(b) On an occasion of a non - availability of such officer (A), should be a class I officer retired from Inland Revenue Service, who has been fully released from that service
(c) On an occasion of a non-availability of qualified officer as in (a)/(b) above and acting appointment may be done from senior, suitable officer, who is in Class II Grade I in Provincial Revenue Service or Inland Revenue Service.
For the purpose of filling up of the vacancy of Provincial Revenue Commission ; application shall call openly, for selecting a suitable officer, ensuring that all the qualified officers for the post (as per the requirements in schedule to this minutes) are given. an equal opportunity to apply. Nevertheless apriority be given to those, who have an experience in a Provincial Revenue Service, amongst other qualifications.
5.4 Direct Recruitments to Provincial Revenue Service can be done for Class III Grade II and Class II Grade II posts if necessary on the basis of results of recruitment Examinations for Class II, Grade II of Class II Grade II, held by commissioner of Examinations, at the request of Inland Revenue Department or on the results of the aforesaid recruitment examinations held by Provincial Public Service Commission.
5.5 The Governor will make the appointment to the post of Provincial Revenue Commissioner, while other appointments and promotions to Class I, Class II and Class III in the Provincial Revenue Service are done by Provincial Public Service Commission.
5.6 Unless specifically expressed for, all the posts set out in the schedule, hereto will hold by the officers in the Provincial Revenue Service.

6. General Conditions :
6.1 Provincial Public Service Commission may appoint a special committee, whenever deems necessary to settle issues, regarding salary differences of adjustments and any other special issues should arise on absorption and appoints of officers from various grades and classes of . Provincial Revenue Service.
6.2 Every officer absorbed to or appointed to Provincial " Revenue Service, be prepared to serve at any of the service status in the North Central Province, as required.
6.3 The qualifying Examinations referred in this sections 2.2.2,3.2,4.2.1,4.3,4.4,4.5,4.5.4 and 4.5.5 respectively, are written Tests, to be held twice a year, (at the beginning . and end of the year)wherever possible. These examinations will be conducted by the Provincial Public Service Commission at the request of Provincial Public Service Commission at the request of Provincial Revenue Commissioner or at the request of Provincial Public Service Commission by any other Provincial Revenue Department or by Commissioner of Examinations.
6.4 Provincial Revenue Commissioner will provide necessary facilities for training and Education as he deems necessary, for the candidates officers, in respect of the Examinations referred in section 2.2.2,3.2,4.2.1,4.3,4.4(A), 4.5.4,4.5.5 and 4.6 in this minutes.
6.5 The details pertaining to Examinations referred in sections 2.2.2, 3.2,4.1,4.2.1,4.3.4.4(A),4.4(B), 4.5.1,4.5.2,4.5.3, 4.5.4, 4.5.5 and 4.6 in this minutes are set out in the appendix hereto.
6.6 Every candidates shall be a physically fit person to serve in any part of the Province and be subjected - to a Medical examination, under the provisions of the establishment code.

7. Service Conditions .- All the officers are subjected to abide by he conditions contemplated by this minutes, regulations, provisions of the Establishment code, financial Regulations, Departmental orders and other rules and Regulations issued by the government ram time to time.

8. Casus Omises.- Any other matter, not provided for by this minutes & procedure, will be determine by the Provincial Public Service Commission subject to the approval of the Hon. Governor.
