NORTH WESTERN PROVINCE

I. R. M. R. Nimal Bandara, the Chief Minister and the Provincial Minister of Finance, Planning, Law and Order, Lands, Agriculture, Animal Husbandry, Irrigation, Highways, Local Government, Transport, Industries and Employment do hereby direct that the Regulations enacted by me under Section 17 of the North Western Province Road Passenger Carriage Services Enactment No. 4 of 1995 of the North Western Provincial Council and published in Part 1V(A) of the Gazette dated 08. 11.1996 of the Democratic Socialist Republic of Sri Lanka shall be amended as follows and take effect from the date of publication in the Gazette.

Delete existing Section 03:03 and substitute with the following Section.



03 : 03 Every application submitted for a new passenger service permit shall be submitted before a period of one month of the expected date of validation of the permit. A temporary permit shall be issued for a period of 02 weeks an approval of the issue of such permit by the Hoard of Directors. The authority shall take steps to cancel the temporary permit or extent it or to issue an Annual Permit after considering any objections if raised against the permit holder. A fee shall be levied for the temporary permit as prescribed in Section 03 : 02(a)v.

03 : 04 "(CM. 180)" in line two of the existing Section 03 :04 shall be amended as "(CM. 170)".

A new section namely Section 03 : 07 shall be substituted immediately after existing Section 03 : 06.

03 : 07 A fee of Rs. 100 shall be changed on each occasion of a service extension necessitated by a permit holder or in case of a lapse on the pan of such permit holder.

Section 04.07 - the words "due to the" before the word "negligence" in line two shall be deleted and substituted with the words "because of and by addition of the following new sentence at the end of the Section. "'However if an omnibus fails to reach its destination in case of an emergency or unavoidable breakdown or unavoidable circumstance a passenger shall be refunded with only the fare due for the balance part to the destination".

04.35 Existing Section 04.35 shall be amended by inclusion of the words "or any other reasonable cause" in between the words "Authority" and "or" in line 02.

05.11 A fee of Rs. 250 in existing Section 5.11 shall be amended as Rs. 150.

06.03 Responsibility of the Conductor of an Omnibus :

Substitute the following Section in place of existing Section 06.03.

"This permit holder shall operate his omnibus on the permitted route to the expected destination. If an omnibus fails to reach the destination due to any breakdown caused as a result of negligence on the part of the permit holder, his employee or agent to all passengers who have duly paid their full fare shall be refunded in full. However if this omnibus fails to reach the destination due to emergency situation or unavoidable breakdown or unavoidable circumstance, only the fare calculated for the balance length of the destination shall be paid".

07.02 Existing Section 07.02 - Sub-section (h) shall be amended as follows:—

Delete words and figures "inches l"x 1 1/12" and substitute 1" x I 1/2" and delete Rs. 500 in last line by inclusion of Rs. 200.

08.03 Rs. 250 in existing Section 08.03 .shall be amended to read as Rs. 150.

10.03 Section 10 is amended by the addition of a new section namely 10.03 immediately after Section 10.02 which shall read as.

'The Authority shall have power to cancel the registration issued by the Authority in case of meeting with punishment in excess of 6 times per year for high speed driving".

The existing Section 10.03 shall be re-numbered as Section 10.04.

11. Existing Section 11 shall be deleted and the following new section substituted.
11.01 A service charge fixed by the Authority shall he paid by the permit holder to the Authority or any other place named by the Authority. This fee shall be paid before the commencement of the month for which it is due and a log sheet issued by the authority should be obtained.
11.02 The Log sheet referred to in Section 11.01 above should be issued by the permit holder to the driver of the omnibus with instructions that the time of commencement and termination of each trip should be noted by the Service Controller/Time Keeper. This log sheet should be taken over after termination of the days operation and kept in safe custody. The permit holder should hand over this at the end of each month to the Authority.
11.03 The monthly service fee per omnibus shall be Rs. 400.
11.04 The permit holder shall pay the Authority the following service charges fixed by the Authority in addition to the charges fixed under Section 03.02 (a) and (b) in connection with offences detected at raids.
(a) Rs. 500 for the first instance when bus operates on passenger transport without a valid route permit.
(b) Rs. 750 on the second instance.
(c) Rs. 1.000 each on third and subsequent instances.
(d) Rs 250 when the route permit is not extended on the proper date.
(e) Rs. 250 for the North Western Province Operators and Rs. 500 for operators of other province's on instances of operating on a route other than the permitted route without a temporary route permit.
(f) Rs. 50 for a person employed as a conductor in an omnibus without a Conductors Licence.
(g) Rs. 50 lor a person employed as a driver not registered under the Authority.
(i) Rs. 200 for any offence detected in connection with unconvincing the passengers with shortcomings in transport service.
11.05 A service charge of Rs. 250 per month will be charged from an omnibus belonging to any other province for terminating a trip in a bus stand of North Western Province as the destination or originating a trip from such bus stand with passengers.
14- After existing Section 14, "An Omnibus" mean a bus used for passenger transport by charging a fare.
Authority means the Road Passenger Transport Authority. Log Sheet means the schedule issued by the Authority to mark the time and departure daily
Operator of the North Western Province means a holder of a Permit issued by the North Western Province Authority.
An Omnibus outside the authority of the North Western Province means a Permit issued by an authority or any other such lawful Institution.
