Air Navigation (Special Provisions)
AN ACT TO AMEND THE AIR NAVIGATION ACT AND THE AIR NAVIGATION (SPECIAL PROVISIONS) ACT, NO. 2 OF 1982

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:”

Short title.

1. This Act may be cited as the Air Navigation (Special Provisions) Act, No. 11 of 1983.

Amendment of section 23 of Chapter 365.

2. Section 23 of the Air Navigation Act (replaced by Act No. 2 of 1982) is hereby amended by the repeal of subsection (3) of that section and the substitution therefor of the following subsection: ”

” (3) The Agent shall retain from and out of the fees, taxes or charges collected or recovered by him on behalf of the Government”

(a) such fee as may be specified by the Minister by Order published in the Gazette, for the services provided by him in the discharge of his functions ; and

(b) such other sum which may be required for capital expenditure as may be determined by the Minister with the concurrence of the Minister in charge of the subject of Finance for the purpose of the development on behalf of the Government of aerodromes or airports, not exceeding fees or charges recovered by him on behalf of the Government in connection with the landing, using or parking of aircraft”.

Amendment of section 8 of Act No. 2 of 1982.

3. Section 8 of the Air Navigation (Special Provisions) Act, No. 2 of 1982, is hereby amended by the substitution for paragraphs (a) and (b) of that section, of the following paragraphs: –

” (a)

(i) all immovable property in the possession and control of the Airports Authority on the day immediately preceding the appointed date shall be transferred to, and vest in, the Director of Civil Aviation ;

(ii) all movable property including money to which the Airports Authority is entitled to, or which is in its possession and control on the day immediately preceding the appointed date shall be transferred to, and vest in, the Agent appointed under section 21A of the Air Navigation Act;

(b)

(i) all rights, privileges and immunities arising from contracts and other obligations of the Airports Authority subsisting on the day immediately preceding the appointed date shall be deemed to be the rights, privileges and immunities of the Agent appointed under section 21A of the Air Navigation Act ;

(ii) all debts, obligations and liabilities incurred, and all contracts, deeds, agreements and other instruments executed or entered into, and all matters and things engaged to be done, by or with, the Airports Authority prior to the appointed date and subsisting on the day immediately preceding the appointed date shall be deemed to have been incurred, executed, entered into or engaged to be done, as the case may be, by or with the Agent appointed under section 21A of the Air Navigation Act;”.
