Board Of Management Of The Ahadiya Academy (Incorporation)
AN ACT TO INCORPORATE THE BOARD OF MANAGEMENT OF THE AHADIYA ACADEMY
Preamble.

WHEREAS a board called and known as the ” Board of Management of the Ahadiya Academy ” has heretofore been established for the purpose of managing and maintaining the educational institution and training centre called the Ahadiya Academy, Kuliyapitiya Centre, at Ahadiya Town. Dummalasuriya:

AND WHEREAS the said board has heretofore successfully carried out and transacted the several objects and purposes for which it was established: AND WHEREAS the aforesaid board has applied to be incorporated and it will be for the public advantage to grant the application:

BE it, therefore, enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows :-

Short title.

1. This Act may be cited as the Board of Management of the Ahadiya Academy (Incorporation) Act, No. 39 of 1984. ;

Incorporation of the Board of Management of the Ahadiya Academy.

(1) From and after the date of commencement of this Act, the persons specified in the Schedule to this Act who are the present members of the Board of Management of the Ahadiya Academy and such persons who shall hereafter be admitted to the membership of the Board in accordance .with the rules of the Board shall be a body corporate with the style and name of the “Board of Management of the Ahadiya Academy “.

(2) The Board of Management of the Ahadiya Academy (hereinafter referred to as “the Board”) shall, in the said name and for the purposes herein mentioned, have perpetual succession and may by the said name sue and be sued in all courts with full power and authority to have and use a common seal and to change and alter the same at its discretion.

General objects of the Board.

3. The general objects of the Board are hereby declared to be-,

(a) the management, development, upkeep and maintenance of the Ahadiya Academy, Kuliyapitiya Centre, situated at Ahadiya Town, Dummalasuriya, and all other institutions connected therewith; and

(b) the management, development and maintenance of any other centres, schools or institutions which may hereafter be established in connection with the aforesaid Academy.

Objects of the Academy.

4. The aims and objects of the Ahadiya Academy, and all other centres, schools and institutions connected therewith are hereby declared to be –

(a) the promotion of the study of Islam and of the institutions, observances and practices relating to Islam and studies pertaining to it;

(b) the provision of vocational and other courses of study with a view to promoting employment, production and leadership;

(c) the establishment of residential training centres for the purposes set out in paragraph (a) and paragraph (b) ; and

(d) the promotion of religious, cultural, social and economic welfare of the people in the area neighboring the aforesaid Academy.

Rules of the Board.

(1) It shall be lawful for the Board from time to time at any general meeting of the members present and by a majority of votes at such meeting to make such rules, not inconsistent with this Act, or any other law, as the Board may deem expedient in respect of all or any of the following matters : –

(a) the constitution of the Board and the term of office of its members and the custody of the seal of the Board;

(b) the conduct of the duties of the Board;

(c) the employment, appointment and termination of services, of necessary personnel and staff to implement the functions, duties and objects of the Board ;

(d) the management, organization and curricula of the centres, schools and institutions connected with the Ahadiya Academy;

(e) the conditions regarding the admission of students to such centres, schools and institutions, the charging and recovering of fees from, and the award of scholarships, grants and exhibitions to, such students;

(f) the keeping of accounts, the deposit of moneys, and the custody of documents; and

(g) providing for any other matter not herein specifically provided for but necessary for the management of the properties and all other affairs and the discharge of the duties, of the Board and for the accomplishment of its objects.

(2) Any rule made by the Board may be amended or rescinded in like manner as a rule may be made under subsection (1).

How the seal of the Board, is to be affixed.

6. The seal of the Board shall not be affixed to any instrument whatsoever except in the presence of two members of the Board, who shall sign their names to the instrument in token of their presence, and such signing shall be independent of the signing of any person as a witness.

Power of Board to hold property.

7. The Board shall, subject to the rules in force for the time being of the Board, be able and capable in. law to acquire either by purchase, exchange, gift, devise or legacy or in any other manner any property, movable or immovable, of any nature and kind whatsoever.

Power to deal with property.

8– The Board may sell, grant, convey, assign, lease, exchange or otherwise dispose of, any property held by the Board or remove any institution established by it or any part thereof, from the site on which it stands to any other site, as may in its opinion be proper or necessary for the better implementation of the objects of the Board,

General powers of the Board.

9. Subject to the provisions of this Act and any other written law, the Board shall have the power to do, perform and execute all such acts, matters and things whatsoever as are necessary, desirable or expedient for the promotion or furtherance of the objects of the Board, or any one of them including the power to invest its funds, to erect any building on any land vested in, or acquired or held by it, to open, operate and close bank accounts, to borrow or raise moneys, with or without security, and to engage, employ and dismiss personnel required for the carrying out of the objects of the Board.

Saving of the rights of the Republic and others.

10. Nothing in this Act contained shall prejudice or affect the rights of the Republic or of any body politic or corporate, or of any other persons, except such as are mentioned in this Act and those claiming by, from or under them.
