Buddhist Temporalities (Amendment)
AN ACT TO AMEND THE BUDDHIST TEMPORALITIES ORDINANCE

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows : ”

Short title and date of operation.

1. This Act may be cited as the Buddhist Temporalities (Amendment) Act, No. 42 of 1981, and shall come into operation on such date as the Minister may appoint by Order published in the Gazette.

Amendment of Chapter 318

2. The Buddhist Temporalities Ordinance (hereinafter referred to as the “principal enactment”) is hereby amended by the substitution”

(a) for the expression ” Public Trustee “, wherever that expression occurs in the principal enactment, other than in sections 2, 9, 15 (4), 46 and 48, of the expression ” Commissioner of Buddhist Affairs ” ; and

(b) for the expression ” Registrar-General”, wherever that expression occurs in the principal enactment, other than in section 2, of the expression ” Commissioner of Buddhist Affairs “.

Amendment of section 2 of the principal enactment.

3. Section 2 of the principal enactment is hereby amend ed as follows : ”

(a) by the insertion, immediately after the definition of “bhikku”, of the following new definition : ” ” Commissioner of Buddhist Affairs ” means the person for the time being holding the office of the Commissioner of Buddhist Affairs and includes any Deputy Commissioner’ ; and

(b) by the omission of the definition of ” Registrar- General “.

Amendment of section 15 of the principal enactment.

4. Section 15 of the principal enactment is hereby amended by the repeal of subsection (4) of that section and the substitution therefor of the following subsection : ”

” (4) Proceedings may be taken under this section in respect of every alleged misfeasance, breach of trust or neglect of duty by any trustee or Viharadhipathi whether committed before or after the commencement of this Ordinance and in respect of such proceedings, the Commissioner of Buddhist Affairs shall have all the powers vested in the Public Trustee for the investigation of the conditions and accounts of trusts by the Public Trustee Ordinance, as amended from time to time.”.

Transfer of rights, liabilities and obligations.

(1) All rights, liabilities and obligations of the Public Trustee and the Registrar-General under the principal enactment immediately prior to the date of commencement of this Act shall be deemed to be the rights, liabilities and obligations of the Commissioner of Buddhist Affairs.

(2) Any act or proceeding commenced under the principal enactment by the Public Trustee or the Registrar-General and not completed before the commencement of this Act may be continued and completed by the Commissioner of Buddhist Affairs.
