AN ACT TO INCORPORATE THE CAPTAIN ANURUDDHA PARAKRAMA WIJEWANTHA MEMORIAL CULTURAL FOUNDATION

Preamble WHERE AS a Foundation called and known as the Captain Anuruddha Parakrama Wijewantha Memorial Cultural Foundation has heretofore been established at Maramba, Matara for the purpose of effectually carrying out and transacting all matters connected with the said Foundation according to the rules agreed to by its members: AND WHEREAS the said Foundation has heretofore successfully carried out and transacted the several objects and matters for which it was established, and has applied to be incorporated, and it will be for the public advantage to grant the application:

BE it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:-

short title

1.This Act may be cited as the Captain Anuruddha Parakrama Wijewantha Memorial Cultural Foundation (Incorporation) Act, No. 3 of 1997.

Incorporation of the Captain Anuruddha Parakrama Wijewantha Memorial cultural Foundation.

2. From and after the date of commencement of this Act such and so many persons as now are members of the,Captain Anuruddha Parakrama Wijewantha Memorial Cultural Foundation (hereinafter referred to as the Foundation) and shall hereafter be admitted as members of the Corporation hereby constituted, shall be a body corporate with perpetual succession under the name and style of the Captain Anuruddha Parakrama Wijewantha Memorial Cultural Foundation (hereinafter referred to as the Corporation) and by that name may sue and be sued in all courts, with full power and authority to have and use a common seal and to change and alter the same at its pleasure.

General objects of the Corporation.

3.The general objects for which the Corporation constituted are hereby declared to be-

(a) to perpetuate the memory of Captain Anuruddha Parakrama Wijewantha, who sacrificed his life to safeguard the independence and unity of Sri Lanka by establishing a Social Welfare Centre at his ancestral home.

(b) to establish an Elders Day Care Centre to provide care for destitute elders and to provide for their physical, mental and intellectual needs and also to provide opportunities for them to participate in social, religious and recreational activities:

(c) to establish and maintain a library, with lending and reference facilities, for the students and to promote the reading habits in the adult population of the area:

(d) to provide scholarships for needy students who achieve success at public examinations:

(e) to provide medical facilities, clothing and shelter for needy orphans and the sick:

(f) to provide welfare facilities for persons whose hearing is impaired, the visually handicapped, the physically handicapped and the mentally retarded:

(g) to identify the socio-economic, religious and cultural needs of the community and to formulate and implement appropriate projects and programmes to meet such needs, and to undertake any other projects that are conducive to the general welfare of the community:

(h) to promote, arrange, organize and hold, exhibitions, lectures, seminars, workshops, classes and conferences in furtherance of the objects of the Corporation;

(i) to co-ordinate and co-operate with other organizations with similar objects to commemorate the heroes who sacrificed their lives for the country in the North East war and to render assistance, wherever, possible, to their families

General powers of the Corporation.

4.Subject to the provisions, of this Act, and any other written law, the Corporation shall have the power to do, perform and execute all such acts, matters and things whatsoever, as are necessary or desirable for the promotion or furtherance of the objects of the Corporation or any one of them, including the power to open, operate and close bank accounts, to borrow or raise money with or without security, to receive or collect grants and donations, to invest its funds and to engage, employ and dismiss, officers and servants required for the purpose of carrying out of the objects of the Corporation.

Rules of the Corporation.

6.

(1) It shall be lawful for the Corporation, from time to time at any general meeting of the members and by a majority of votes of members present and voting to make such rule as are not inconsistent with the provisions of this Act or any other written law, and to alter, vary rescind or delete them.

(2) All members of the Corporation shall be subject to the rules in force for the time being of the Corporation.

Seal of the Corporation.

7.The seal of the Corporation shall not be affixed to any instrument whatsoever, except in the presence of two members of the Committee of Management who shall sign the instrument in token of their presence. Such signing shall be independent of the signing of any person as a witness.

Saving of the rights of the Republic and others.

8.Nothing in this Act Contained shall prejudice or affect the rights of the Republic, or of any body politic or corporate or of any other persons, except such as are mentioned in this Act and those claiming by, from or under them.

Sinhala text to prevail in case of inconsistency.

9. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
