As ACT TO INCORPORATE THE CENTRAL TENNEKUMBUHA YOUNG MEN’S MUSLIM ASSOCIATION.
Preamble.

WHEREAS an Association called and known as the ” Central Tennekumbura Young Men’s Muslim Association is heretofore been established at Tennekumbura in Sri Lanka for the purpose of effectually carrying out and transacting ail matters connected with the said Association, according to the rules agreed to, by its members ;

AND WHEREAS the said Association has heretofore successfully carried out, and transacted, the several objects and matters for which it was established and has applied to be incorporated and it will be for the public advantage to grant the application :

BE it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows ; ”

Short title.

1. This Act may be cited as the Central Tennekumbura Young Men’s Muslim Association (Incorporation) Act,

Incorporation of the Central Tennekumbura Young Men’s Muslim Association,

2. From and after the date of commencement of this Act, such and so many persons as now are members of the Central Tennekumbura Young Men’s Muslim Association (hereinafter referred to as ” the Association “) or shall hereafter be admitted as members of the Corporation hereby constituted, shall be a body corporate (hereinafter referred to as ” the Corporation “) with perpetual succession under the name and style of the ” Central Tennekumbura Young Men’s Muslim Association ” and by that name may sue, and be used, in all courts, with full power and authority to have, and use, a common seal and to alter the same at Its Treasure.

General objects of the Corporation.

3. The general objects for which the Corporation is established are hereby declared to be –

(a) to propagate the virtues of Islam, its culture and traditions;

(b) to promote the religious, spiritual “.and cultural welfare of Muslims;

(c) to improve the social, economic and educational standards of Muslims ;

(d) to work as a religious and social organisation, free of political commitments or affiliations;

(e) to assist and encourage religious, social, cultural, educational and sports activities of ail the communities and of the Muslims in particular :

(f) to promote inter communal and international peace and harmony, and with this end in view, to work with other communities and peoples ;

(g) to promote education in general, and Muslim education in particular ;

(h) to obtain and grant scholarships to deserving students and to render assistance in any other form as may be deemed necessary to deserving students to enable them to pursue their studies ;

(i) to encourage its members to act in a manner not inconsistent with the Islamic faith, culture and traditions ;

(j) to maintain contacts with other organisations and institutions in Sri Lanka and abroad, with similar objects ;

(k) to obtain assistance from state and other organisations in Sri Lanka and abroad for the accomplishment of its objects ;

(l) to establish and maintain orphanages and homes for the aged and destitute ;

(m) to establish social welfare centres :

(n) to promote and assist in the distribution of ‘ Zakath ‘ and ‘ Fithra ‘ ;

(o) to establish libraries, and reading rooms and to publish and print Islamic literature and other publications; in relation to the objects of the Corporation ; and

(p) to do all such other acts and things as are incidental or condusive to the attainment of the above objects or any one of them.

General powers of the Corporation.

4. Subject to the provisions of this Act and any other written law, the Corporation shall have the power to do, the perform and execute all such acts, matters and things whatsoever as are necessary or desirable for the promotion or furtherence of the objects of the Corporation, or any one of them including the power to open, operate and close bank accounts, with or without security, to receive or collect grants and donations, to invest its funds and to engage, employ and dismiss officers and servants required for the purpose of earring out the objects of the Corporation.

Management of the affairs of the Corporation.

(1) The affairs of the Corporation shall, subject to the other provisions of this act and the rules in force for the time being of the Corporation, be administered by an Executive Committee consisting of the office-bearers and such other persons as may be provided for in such rules and elected in accordance therewith.

(2) The first Executive Committee of the Corporation shall be the Executive Committee of the Association holding office on the day proceeding the date of commencement of this Act.

(3) The Executive Committee may delegate any of its functions to one or more standing or such other committees.

Board of Trustees.

(1) All immovable property of the corporation shall, subject to the rules of the Corporation, be entrusted to a Board of Trustees consisting of five members elected in accordance with such rules.

(2) The first Board of Trustees of the Corporation shall be the Board of Trustees of the Association holding office at the date of commencement of this Act.

Rules of the Corporation.

(1) It shall be lawful for the Corporation at a special general meeting of the Corporation convened for the purpose and by a majority of not less than two-thirds of its members present and voting, to make rules not inconsistent with the provisions of this Act and any other written law, for the admission, withdrawal and expulsion of members of the Corporation for the election of the office-bearers and the Executive Committee, for the procedure to be followed in the transaction of business, and otherwise generally, for the management of the affairs of the Corporation and the accomplishment of its objects. Such rules, when made may at a like meeting and in like manner, be altered, added to. amended or rescinded.

(2) The members of the Corporation shall be subject to the rules of the Corporation.

Debts due by and payable to the Association.

8. All debts and liabilities of the Association existing on the day preceding the date of commencement of this Act shall be paid by the Corporation and all debts due to, and subscriptions and contributions payable to, the Association, on that day shall be paid to the Corporation for the purposes of this Act,

Corporation may hold property movable and immovable.

9. Subject to the provisions of this Act, the Corporation shall be able and capable in law to take and hold any property. movable or immovable, which, may be vested in it by virtue of any purchase, grant, gift, testamentary disposition or otherwise and all such property shall be held by the Corporation for the purposes of this Act and subject to the rules in force for the time being of the Corporation, with full power to sell, mortgage, lease, exchange or otherwise dispose of the same,.

Seal of the Corporation.

10. The seal of the Corporation shall be in the custody of the General Secretary and it shall not be affixed to any instrument whatsoever except in the presence of the President and the General Secretary or the Treasurer who shall sign their names on the instrument in token of their presence and such signing shall be independent of the signing of any such person as a witness.

Life Secretary-General.

11. The First Secretary-General of the Corporation shall be the Secretary-General of the Association holding office on the clay preceding the date of commencement of this Acts whose name is specified in the Schedule to this Act, and who shall be the Secretary-General of the Corporation, for life, until he dies or makes a written request to the Executive Committee to be relieved of duties of that post.

Saving of the rights of the Republic and others.

12. Nothing in this Act contained shall, prejudice or effect the rights of the Republic of Sri Lanka or of any body politic or corporate, or of any other persons except such as are mentioned in this Act. and those claiming by, from, or under, them.

Sinhala text to prevail in case of inconsistency.

13. In the event of any inconsistency between the Sinhala and Tamil texts of this Act. the Sinhala text shall prevail.

Schedules
