Ceylon Institute Of Scientific And Industrial Research (Amendment)
AN ACT TO AMEND THE CEYLON INSTITUTE OF SCIENTIFIC AND INDUSTRIAL RESEARCH ACT.

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:

Short title.

1. This Act may be cited as the Ceylon Institute of Scientific and Industrial Research (Amendment) Act, No. 19 of 1981.

Amendment of section 3 of Chapter 164.

2. Section 3 of the Ceylon Institute of Scientific and Industrial Research Act (hereinafter referred to as the “principal enactment”) is hereby amended as follows:

(1) by the relettering of paragraphs (c), (d), (e), (f) and (g) as paragraphs (e), (f), (g), (h) and (i) of that section ; and

(2) by the insertion, immediately after paragraph (b) of that section, of the following paragraphs :

” (c) to undertake, or to collaborate in, the surveying and monitoring of environmental pollution with the object of devising remedial measures to reduce or eliminate such pollution ;

(d) to engage in technology transfer activities and to offer services in respect of technology transfer to the Government or to other institutions in Sri Lanka.”.

Amendment of section 5 of the principal enactment.

3. Section 5 of the principal enactment as amended by Law No. 51 of 1973, is hereby further amended by the repeal of subsection (2) of that section, and the substitution therefor, of the following new subsection:

” (2) The board shall consist of

(a) five members appointed by the Minister, each of whom has distinguished himself in science or industry or is otherwise specially qualified in relation to some aspect of the work of the Institute ;

(b) one member nominated by the Minister in charge of the subject of Finance ;

(c) the chief executive or his nominee, of any one of the following institutions :

(i) the National Development Bank of Sri Lanka, established by the National Development Bank of Sri Lanka Act, No 2 of 1979.

(ii) the Development Finance Corporation of Ceylon, established by the Development Finance Corporation of Ceylon Act (Chapter 163) ;

(iii) any other lending institution which provides financial assistance (or the purpose of industrial development, nominated by the Minister ; and

(d) the following two ex officio members

(i) the person for the time being holding office as Secretary to the Ministry under which the Institute functions, or such other officer of such Ministry as the Secretary to the Ministry may appoint; and

(ii) the person for the time being holding office as the director of the Institute.”.

Amendment of section 8 of the principal enactment.

4. Section 8 of the principal enactment is hereby amend- ed, by the repeal of subsection (2) of that section, and the substitution therefor, of the following new subsection :

“(2) A member of the board who is not an ex officio member may resign office by writing under his hand addressed to the Minister.”.

Replacement of section 10 of the principal enactment.

5, Section 10 of the principal enactment is hereby re- pealed and the following new section substituted there- for:

” Remuneration of members of the board.

10. The Members of the board other than the director of the Institute may be remunerated out of the funds of the Institute In such manner and at such rates as may be specified by the Minister, with the concurrence of the Minister in charge of the subject of Finance, by Order published in the Gazette.”,

Replacement of section 12A of the principal enactment.

6. Section 12A of the principal enactment inserted therein by Law No. 51 of 1973, is hereby repealed and the following new section substituted therefor :

“Appointment of a research planning Council.

12A.

(1) The Minister shall appoint a scientific advisory council, called the Research Planning Council, composed of the director of the Institute, the deputy director or deputy directors of the Institute, heads of research divisions and sections, and six other persons, being persons not In the employ of the Institute, each of whom shall have distinguished himself in science, engineering or industry or is otherwise specially qualified in relation to some aspect of the work of the Institute.

(2) The function of the Research Planning Council shall be to advise the board on all aspects of the Institute’s activities relevant to its research and development functions. The mode and manner of the conduct of meetings of such Council shall be determined by the Council”.

Amendment of section 19 of the principal enactment.

7. Section 19 of the principal enactment is hereby amended by the repeal of subsection (4) of that section end the substitution of the following new subsection therefor :

” (4) The director or deputy director and the accountant shall sign any cheque drawn on the account of the Institute in any bank, and, if any two of them are absent, a member of the board or on officer of the Institute authorized for the purpose by the board being a member or officer whose signature is registered for such purpose by such bank shall sign the cheque in place of the absentees, and, if the director, deputy director, and the accountant are absent, two members of the board or two officers of the Institute who have been authorized for the purpose by the board, being members or officers whose signatures are so registered shall sign such cheque,”.
