AN ACT TO INCORPORATE THE CHINMAYA MISSION OF SRI LANKA
preamble.

WHEREAS His Holiness- Swami Chinmayananda has over the years encouraged the study of the Hindu scriptures and philosophy and guided people all over the world, to enable them to envelope to the height of Self-Realisation.

And whereas these aspirants in Sri Lanka inspired by his teachings, and guidance founded an Association called and known as the Chinmaya Mission of Sri Lanka whose membership comprises of such aspirants desirous of effectually carrying out in Sri Lanka and elsewhere la message as well as transacting the various matters connected with the said Association according to the rules. agreed by its members :

And whereas the said Association has applied to be incorporated and it will be for the public advantage to grant the application

BE it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows

short title.

1.This Act may be cited as the Chinmaya Mission of Sri Lanka (Incorporation) Act, No 28 of 1981

Incorporation of the Chinmaya Mission of Sri Lanka .

2 From and after the date of commencement of this Act, such and so many persons as now are members Chinmaya Mission of Sri Lanka (hereinafter referred to as “the Mission”) or shall hereafter be admitted members of the Corporation hereby constituted shall be a body corporate (hereinafter referred to as the Corporation”) with perpetual succession, under the name and style of the ” Chinmaya Mission of Sri Lanka”, and by that name may sue and be sued in all courts with full power and authority to have and use a common seal and alter the same at its pleasure,

General objects of the Corporation.

3. The general objects for which the Corporation, is constituted are hereby declared to be : –

(a) to promote universal brotherhood amongst all sections of the people in accordance with Sanadhana dharma teachings ;

(b) In assist in the promotion of racial religious and communal harmony and eradication of social disabilities.

(c) to co-operate with local and foreign organizations in the pursuit of peace and harmony among the people of the world ;

(d) to promote and encourage the study of comparative religious and all systems of Hindu philosophy and for this purpose to establish an International Hindu Centre for the study of Hindu philosophy ;

(e) to provide, establish, endow, maintain, control and manage Veda Agama Schools, Gurukulams, Ashrams- and similar institutions to further the dims and objects of the Corporation and also grant loans, award scholarships and prizes and provide other facilities for deserving student in Sri Lanka and abroad;

(f) to train students and others for a life of dedication and service to mankind and for the propagation of the spiritual culture and wisdom of Vedanta philosophy;

(g) to conduct Gyana Yagnas, Study Groups, Devi Groups, Bal Vihars, Balmandirs, Bhajan Groups, Classical Carnatic Music Classes, Teenagers’ Classes or Groups and any other activity allied or incidental thereto ;

(h) to construct, maintain and administer orphanages, clinics, hospitals, diagnostic centres, community halls, and to extend medical relief and aid in any manner to the needy ;

(i) to give aid either in cash or in kind to the monks, volunteers and others engaged in the propagation of the objects of the Corporation ;

(j) to promote, arrange, organize and hold exhibitions, lectures, seminars, symposia, workshops, classes, debates, conferences, tours, excursions or any other functions for the furtherance of the objects of the Corporation ;

(k) to provide and maintain libraries, to subscribe for and issue books, journals, souvenirs and periodicals and such other services as may be deemed desirable for carrying out the objects of the Corporation ;

(l) to institute and establish scholarships, rewards, grants and prizes and to encourage spiritual philosophical or cultural studies.

(m) to co-operate and associate with other associations; societies or organizations having objects altogether or in part similar to those of the Corporation ;

(n) to send delegates to religious, philosophical or peace conferences In Sri Lanka or abroad ;

(o) to be in constant touch with the Chinmaya Missions in other countries, exchange ideas and co-operate with them in the furtherance of the objects and purposes of the Corporation

(p) to print, publish, sell and distribute journales, periodicals, newspaper and magazines, extolling the objects of the Corporation and for this purpose to own or take on lease a printing press and employ thereon such personnel as may be necessary to conduct .such activities ; and

(q) generally to do such other things as are or may be necessary, conducive or incidental to the attainment of the objects of the Corporation-

Management of the affairs of the Corporation,

(1) The affairs of the Corporation shall, subject to the rules in force for the time being of the Corporation, be administered by an Executive Committee consisting of such number of persons to be nominated, elected or appointed in accordance with such rules.

(2) The first Executive Committee of the Corporation shall be the Executive Committee of the Mission holding office at the time of the coming into operation of this Act,

(1) The Corporation may, from time to time, at a general meeting and by a vote of two-thirds of the members Present and voting thereat, make rules for the admission to, and removal from, membership of the Corporation, for the performance of the duties of the office-bearers and other members of the Executive Committee of the Corporation. for the procedure in the transaction of business, and other-wise generally for the management of the affairs of the Corporation and the accomplishment of its objects.

(2) The rules of the Mission in force at the time of the coming into operation of this Act shall be deemed to be the rules of the Corporation made under this section.

(3) Any rule of the Corporation for the time being in force or any rule which any hereafter be passed, may be added to amended or rescinded in like manner as a rule may be made under subsection (1).

(4) All members of the Corporation shall be subject to the rules of the Corporation.

Debts due by and payable to the Mission.

6. All debts and liabilities of the Mission existing at the time of coming into operation of this Act shall be paid by the Corporation hereby constituted and all debts due to and subscriptions and contributions payable to the Mission shall be paid to the Corporation for the purposes of this Act.

How seal of the Corporation is to be affixed.

7. The seal of the Corporation shall not be affixed to any instrument whatsoever except in the presence of two of the members of the Executive Committee, duly authorized, who shall sign their names to the instrument in token of their presence, and such signing shall be independent of the signing of any person as a witness.

Corporation may hold property movable and immovable.

8. The Corporation shall be capable in law to take over and hold any property, movable or immovable, which may become vested in it by virtue of any purchase, grant, gift, testamentary disposition or otherwise, and all such property shall be held by the Corporation for the purposes of this Act and subject to the rules in force for the time being of the Corporation, with full power to sell, mortgage, lease, exchange or otherwise dispose of the same.

Property remaining on dissolution.

9. If upon the dissolution of the Corporation there remains, after the satisfaction of all debts and liabilities, any property whatsoever such property shall not be distributed among the members of the Corporation but shall be given or transferred to some other association or associations having objects similar to the Corporation, and which is or are by the rules thereof prohibited from distributing any income or property among its or their members Such association or association shall be determined by the members of the Corporation at or immediately before the time of the Corporation.

Saving of rights of the Republic and others.

10. Nothing in this Act contained shall prejudice or affect the rights of the Republic or of any body politic or corporate or of any other persons, except such as are mentioned in this Act., and those claiming by, from or under them.
