Colombo Grand Mosque(Incorporation)
AN ACT TO INCORPORATE THE COLOMBO GRAND MOSQUE

WHEREAS, there has been in existence in the City of Colombo, for a period of more than four hundred and fifty years a place of Islamic worship which has come to be commonly known as the Colombo Grand Mosque:

AND whereas an Association called and known as the Congregation of the Colombo Grand Mosque has heretofore been established in Colombo for the purpose of effectually carrying out and transacting all matters connected with the said Colombo Grand Mosque according to the rules agreed to by its members:

And whereas the said Association has heretofore successfully carried out and transacted the several objects and matters for which it was establishment and has applied to be incorporated and it will be for the public advantage to grant the application:

Be it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:-

Short title.

1. This Act may be cited as the Colombo Grand Mosque (Incorporation) Act, No.22 of 1986.

Incorporation of the Colombo Grand Mosque.

2. From and after the date of commencement of this Act, such and so many persons as now are members of the Congregation of the Colombo Grand Mosque (hereinafter referred to as the Mosque) or shall hereafter be admitted members of the Corporation hereby constituted, shall be a body corporate (hereinafter referred to as the Corporation hereby constituted, shall be a body corporate (hereinafter referred to as the Corporation) with perpetual succession, under the name and style of the Colombo Grand Mosque and by that name may sue and be sued in all Courts, with full power and authority to have and use a common seal and alter the same at their pleasure.

General objects of the Corporation.

3. The general objects of the Corporation are hereby declared to be-

(a) the construction, restoration, maintenance and upkeep of the Mosque as a place of Islamic worship, culture and society;

(b) the restoration, maintenance and upkeep of the Shrines, and burial places which are appurtenant to the Mosque;

(c) the provision of facilities and all things as are necessary as has hitherto been provided for the advancement of education;

(d) the relief of hunger, disease and sickness by the provision of sustenance, nourishment, medical care, clothing and shelter to the needy, the orphan, the indigent and the sick;

(e) the collection and distribution of voluntary public charity, Zakat and Sadaqa ; and

(f) generally the doing of all such acts and things as are incidental or conductive to the attainment of the above objects or any of them.

Management of the affairs of the Corporation.

(1) The affairs of the Corporation shall, subject to the rules in force for the being of the Corporation, be administered by the Board of Trustees to be elected, in accordance with the rules in force for the time being of the Corporation.

(2) The first Board of Trustees of the Corporation shall be the Board of Trustees holding office at the date of commencement of this Act.

Custody of property.

5. The custody of all property both movable and immovable belonging to the Corporation shall subject to the rules for the time being of the Corporation, be vested in the Board of Trustees.

Rules of the Corporation.

(1) It shall be lawful for the Corporation at an Annual General Meeting or at any meeting specially called for the purpose and by a majority which is not less than two-thirds of the members present and voting at such meeting to make such rules as are not inconsistent with the provision of this Act, as it may deem expedient, for all or any of the following matters:-

(a) the admission, withdrawal or expulsion of members;

(b) the powers, conduct and duties of the Board of Trustees, the various officers, agents and servants of the Corporation;

(c) the procedure to be observed at meetings and in the transaction of the business of the Corporation;

(d) the administration and management of the Corporation;

(e) the determination of subscription payable by the members and the collection of such subscriptions; and

(f) generally the management of the affairs and the accomplishment of its objects.

(2) Such rules when made, may, at a meeting, and in like manner be altered, added to, amended, or rescinded, subject however to the requirements of subsection (3).

(3) No rule of the Corporation shall be altered, added to, amended or rescinded unless at least fifteen days prior notice of such alteration, addition, amendment or cancellation shall have been given to the members.

Debts due by and payable to the Mosque.

7. All debts and liabilities of the Mosque existing at the time of the coming into operation of this Act shall be paid by the Corporation and al debts due to, and subscriptions and contributions payable to the Mosque, shall be paid to the Corporation for the purpose of this Act.

Seal of the Corporation.

8. The Seal of the Corporation shall not be affixed to any instrument whatsoever except in the presence of the President and any three members of the Board of Trustees, who shall, sign the instrument in token of their presence and such signing shall the instrument in token if their presence and such signing shall be independent of the signing of any person as a witness.

Corporation may hold property movable and immovable.

9. The Corporation shall be able and capable in law take and hold any property, movable, or movable or immovable, which may become vested in it by virtue of any purchase, grant, gift, testamentary disposition or otherwise, and all such property shall be held by the Corporation for the purpose of this Act and subject to the rules for the purpose of this Act and subject to the rules for the time being in force of the Corporation with full power to sell, mortgage, lease, exchange or otherwise dispose of same.

Saving the rights of the Republic and others

10. Nothing in this Act contained shall prejudice of affect the rights of the Republic, or of any body politic or corporate, or of any other persons, except such as are mentioned in this Act and others claiming by, from or under them.
