Excise (Amendment) Law


A LAW TO AMEND THE EXCISE ORDINANCE

BE it enacted by the National State Assembly of the Republic of Sri Lanka as follows :-
Short title.
1. This Law may be cited as the Excise (Amendment) Law, No. 14 of 1977.
Insertion of new section 28A in Chapter 52.
2. The following new section is hereby inserted immediately after section 28 of the Excise Ordinance and shall have effect as section 28A of that Ordinance:-

” Powers of Minister in respect of licences.
28A.

(1) Notwithstanding anything in this Ordinance, if, upon representation made or otherwise, the Minister considers it necessary to do so, he may, without assigning any reason therefor, direct the authority granting a licence, to grant a licence, or to renew or cancel a licence, and such authority shall give effect to such direction.
(2) No action for compensation or damages shall lie in respect of the cancellation, on a direction given by the Minister under subsection (1), of any licence by the authority granting such licence.”.
