AN ACT TO INCORPORATE THE GAMPAHA SIDDHAYURVEDA COLLEGE IN THE NAME AND STYLE OF THE GAMPAHA WICKRAMARACHCHI AYURVEDA VIDYALAYA.
Preamble.

WHEREAS a college called and known as ” The Gampaha Siddhayurveda College” has heretofore been established and managed by the late Pandit G. P. Wickramarachchi at Gampaha for the purpose of effectually carrying out its objects according to the rules agreed to by its members :

AND WHEREAS the said college has heretofore successfully carried out its objects and with the concurrence of its members it has become necessary for its development and continuance and for the public advantage to be incorporated:

BE it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:

Short title.

1. This Act may be cited as the Gampaha Wickramarachchi Ayurveda Vidyalaya (Incorporation) Act, No. 30 of 1982.

Incorporation of the Gampaha Siddhayurveda College.

2. From and after the date of commencement of this Act, the members of the Palaka Sabawa for the time being of the said Gampaha Siddhayurveda College, and such and so many persons as now are members of the said Gampaha Siddhayurveda College or shall hereafter be admitted of the Corporation hereby constituted, shall be a body corporate (hereinafter referred to as “the Corporation”) with perpetual succession under the name and style of ” The Gampaha Wickramarachchi Ayurveda Vidyalaya (herein after referred to as ” the Vidyalaya “) and by that name may sue and be sued in all courts, with full power and authority to have and use a common seal and alter the same at its pleasure.

The General objects of the Corporation.

3. The general objects for which the Corporation is constituted are hereby declared to be

(a) to conduct and administer the Vidyalaya as a broad national institution oriented to impart instructions in the indigenous, Sidha and Ayurvedic systems of medicine ;

(b) to establish an ayurvedic hospital to train medical students and provide free medical aid to patients;

(c) to conduct examinations for the purpose of ascertaining the persons who have acquired proficiency in the field of ayurveda; and

(d) to construct, equip and maintain necessary buildings for the use of the Vidyalaya.

General powers of the Corporation.

4. Subject to the provisions of this Act and any other written law the Corporation shall have the power to do, perform and execute all such acts, matters and things whatsoever as are necessary or desirable for the promotion and furtherance of the objects of the Corporation or any one of them including the power to open, operate and close bank accounts, to borrow or raise moneys with or without security, and to engage, employ and dismiss personnel required for the carrying out of the objects of the Corporation.

Management of the affairs of the Corporation.

(1) The affairs of the Corporation shall, subject to the rules of the Corporation, be administered by the Palaka Sabawa consisting of the office-bearers and such other persons as may be provided for in such rules and elected in accordance therewith.

(2) The first Palaka Sabawa of the Corporation shall be the members of the Palaka Sabawa of the Vidyalaya holding office at the time of the coming into operation of this Act.

Rule of the Corporation.

(1) It shall be lawful for the Corporation, from time to time, at any general meeting of the members and by the votes of at least two-thirds of the members present and voting, to make such rules as are not inconsistent with the principles and provisions of this Act or any other law for the management of the affairs of the Corporation and the accomplishment of its objects. Such rules when made may at a like meeting and in like manner be altered, added to, amended or rescinded.

(2) The members of the Corporation shall be subject to the rules of the Corporation.

Debts due by and payable to the Gampaha Siddhayurveda College.

7. All debts and liabilities of the Gampaha Siddhayurveda College existing at the time of the coming into operation of this Act shall be paid by the Corporation and all debts due to and subscriptions and contributions payable to the Gampaha Siddayurveda College, shall be paid to the Corporation.

Corporation to hold property, movable and immovable

8. The Corporation shall be able and capable in law to take and hold any property movable or immovable, which may become vested in it by virtue of any purchase, grant, gift, testamentary disposition or otherwise, and all such property shall be held by the Corporation for the purposes of this Act, and subject to the rules of the said Corporation, with full power to sell, mortgage, lease, exchange or otherwise dispose of the same.

How the seal of corporation is to be affixed.

9. The seal of the Corporation shall not be affixed to any instrument whatsoever except in the presence of such number of persons as may be provided for in the rules of the Corporation who shall sign their names to the instrument in token of their presence and such signing shall be independent of the signing of any person as a witness.

Fund of the Corporation

10.

(1) There shall be established a Fund called ” The Gampaha Wickramarachchi Ayurveda Vidyalaya Fund” (hereinafter referred to as ” the Fund “) for the maintenance and welfare of the Vidyalaya.

(2) Parliament may from time to time vote sums of money to such Fund.

(3) Such sums of money voted by Parliament shall be disbursed only with the approval of, and under the super vision of, a committee consisting of the following:

(a) the Commissioner of Ayurveda who shall be the Chairman of the Committee ;

(b) the President of the Palaka Sabawa ;

(c) the Treasurer of the Palaka Sabawa ;

(d) the Secretary to the Ministry of the Minister in charge of the subject of Higher Education or his representative ; and

(e) the Secretary to the Ministry of the Minister in charge of the subject of Finance or his representative.

(4) The accounts of the Fund shall be audited in accordance with Article 154 of the Constitution.

Saving of the right of the Republic the others.

11. Nothing in this Act contained shall prejudice or affect the rights of the Republic of Sri Lanka, or of any body politic or corporate, or of any other persons, except such as are mentioned in this Act, and others claiming by, from or under them.
