Judicature (Amendment)
AN ACT TO AMEND THE JUDICATURE ACT. NO. 2 OF 1978.

BE it enacted by the Parliament of the Democratic Socialist Short title. Republic of Sri Lanka as follows

Short title.

1. This Act may be cited as the Judicature Amendment) Act, No. 29 of 1991.

Amendment of section 45 of Act No. 2 of 1978.

2. Section 45 of the Judicature Act, No. 2 of 1978 (hereinafter referred to as the ” principal enactment”) is hereby amended by the insertion, immediately after subsection (1) of that section, of the following new subsection: ”

” (1A) The Minister may by regulation specify the officers (whether holding office permanently or temporarily) who shall be ex officio Justices of the Peace for the Republic of Sri Lanka or for any portion thereof, respectively, as is indicated in such regulation. “.

Amendment of the Fifth Schedule to the principal enactment.

3.The Fifth Schedule to the principal enactment is hereby amended as follows:-

(1) by the insertion, immediately before the item ” All Councilors of Municipal Councils and Members of Urban Councils, for their respective Municipal Council and Urban Council areas ;” appearing under the heading ” JUSTICES OF THE PEACE FOR PORTIONS OF SRI LANKA ” of the following new item :

” All members of Provincial Councils, for the respective Provinces for which such Councils are established;”; and

(2) by the substitution, for the item “All elected Members of Development Councils for the respective Administrative Districts for which such Councils are constituted”, of the following item :-

“The Chairmen Vive-Chairmen and other members of Pradeshiya Sabhas, for the respective Pradeshiya Sabha areas for which such Pradeshiya Sabhas are constituted ; “.

Sinhala text to prevail in case of Inconsistency.

4. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
