AN ACT TO AMEND THE LICENSING OF SHIPPING AGENTS ACT, NO. 10 OF 1972 AND TO PROVIDE FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO.

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows :-
|

Short title.
|
1.This Act may be cited as the Licensing of Shipping Agents (Amendment) Act, No. 18 of 2002.
|
|
Amendment of the long title to Act, No. 10 of 1972.
|
2.The Long Title to the Licensing of Shipping Agents Act, No. 10 of 1972, (hereinafter referred to as the” principal enactment”) is hereby amended by the substitution for the words” BUSINESS OF A SHIPPING AGENT; of the words” BUSINESS OF A SHIPPING AGENT, FREIGHT FORWARDERS, NON VESSEL OPERATING COMMON CARRIERS, AND CONTAINER OPERATORS;.

Licensing of Shipping Agents Act, and the Shipping Agents to be known as Licensing of Shipping Agents, Freight Forwarders and Non Vessel Operating Common Carriers and Container Operators Act. and the Shipping Agents. Freight Forwarders non Vessel Operating Common Carriers and Container Operators respectively.
|
3.(1) In the principal enactment and in any other written law, there shall be substituted
|
(a)for the words,” Licensing of Shipping Agents Act” of the words; “Licensing of Shipping Agents, Freight Forwarders, Non Vessel Operating Common Carriers, and Container Operators Act;
|
|
(b)for the words,” Shipping Agents ” of the words; “Shipping Agents, Freight Forwarders, Non Vessel Operating Common Carriers and Container Operators.
|
|
(2) Every reference to the;” Licensing of Shipping Agents Act” ” and; “Shipping Agents” in any notice, notification, contract, communication or other document shall be read and construed as a reference to ” Licensing of Shipping Agents, Freight Forwarders, Non Vessel Operating Common Carriers and Container Operators Act”, and, “Shipping Agents, Freight Forwarders, Non Vessel Operating Common Carriers and Container Operator,” respectively.

Amendment of section 15 of the principal enactment.
|
4. Section 15 of the principal enactment is hereby amended as follows :-
|
(1)by the insertion immediately after the definition of the expression” appropriate authority” of the following new definition :-
|
|
“container operators” means a person engaged in the business of container terminal, container depot and container freight station operation in Sri Lanka ;
|
|
” freight forwarders” means any person engaged in the business of International Freight Forwarding which includes undertaking the carriage or the procurement of the carriage by air, sea, or land and the provision of other services connected with such carriage, but shall not include any services provided by a person for the carriage of goods or services provided solely as the agent of an airline or ship owner or charterer of a ship

(2)by the insertion immediately after the definition of the expression” license” of the following new definition :-
|
|
” Non Vessel Operating Common Carrier” means a freight forwarder who also engages in the functions of a carrier ;
|
|
|
Sinhala text to prevail in case inconsistency.
|
5. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
