Local Authorities Elections (Amendment)


AN ACT TO AMEND THE LOCAL AUTHORITIES ELECTIONS ORDINANCE.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Senate and the House of Representatives of Ceylon in this present Parliament assembled, and by the authority of the same, as follows :
Short title.
1. This Act may be cited as the Local Authorities Elections (Amendment) Act, No. 80 of 1970.
Amendment of section 13 of Chapter 379.
2. Section 9 of the Local Authorities Elections Ordinance is hereby amended as follows:

(1) in sub-section (1) thereof, by the substitution, for paragraph (d) of the following paragraph:

“(d) is

(i) a judicial officer, or
(ii) a member of the Armed Forces, or
(iii) a police officer, or
(iv) a peace officer exercising police functions under the Criminal Procedure Code, or
(v) a public officer in any Government Department holding any office the initial of the salary scale of which is not less than Rs. 6,720 per annum, or
(vi) an officer in any Government Corporation holding any office the initial of the salary scale of which is not less than Rs. 7,200 per annum; or ” ; and
(2) by the substitution, for sub-section (5) thereof, of the following sub-section:

“(5) For the purposes of this section

(a) ” judicial officer ” means a person holding judicial office within the meaning of the Ceylon (Constitution) Order in Council, 1946, and shall not include

(i) a Justice of the Peace ;
(ii) a Justice of the Peace and Unofficial Magistrate;
(iii) a Commissioner for Oaths; and
(iv) an inquirer appointed under section 120 of the Criminal Procedure Code;
(b) ” police officer “means a member of the police force established under the Police Ordinance;
(c) ” Armed Forces ” means the Ceylon Army, the Royal Ceylon Navy, and the Royal Ceylon Air Force; and
(d) ” Government Corporation ” means a Corporation the capital of which is wholly or partly subscribed by the Government.’.
