Naming Of Streets And The Control Of The Erection Of Monuments Law
A LAW TO PROVIDE FOR THE NAMING OF STREETS AND FOR THE CONTROL OF THE ERECTION OF MONUMENTS ON PUBLIC PROPERTY AND FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO.

BE it enacted by the National State Assembly of the Republic of Sri Lanka as follows:

Short title.

1. This Law may be cited as the Naming of Streets and the Control of the Erection of Monuments Law, No. 4 of 1975.

Date of operation.

2. This Law shall come into operation on such date as the Minister may determine by Order published in the Gazette.

Amendment of section 71 of the Municipal Councils Ordinance (Chapter 252).

3. Section 71 of the Municipal Councils Ordinance is hereby amended as follows: –

(1) by the substitution, for subsection (1) of that section, of the following subsection:-

” (1) The Minister shall, either by his own motion or on application made in that behalf by a Municipal Council, determine the name by which any street shall be known and in like manner at any time alter the name of any street.”; and

(2) by the repeal of subsection (2) of that section.

Amendment of the Urban Councils Ordinance (Chapter 255).

4. The Urban Councils Ordinance is hereby amended as follows: –

(1) in section 55, by the substitution for paragraph (3), of the following paragraph: –

” (3) to paint up the names of streets and the numbers of houses or tenements on any private property; “; and

(2) by the insertion, immediately after section 55, of the following new section which shall have effect as section 55A: –

“Naming of streets.


55A. The Minister shall, either of his own motion or on application made in that behalf by an Urban Council, determine the name by which any street shall be known and in like manner at any time alter the name of any street.”

Amendment of the Town Councils Ordinance.

5. The Town Councils Ordinance is hereby amended as follows: –

(1) in section 57, by the substitution for paragraph (3) thereof, of the following paragraph: –

” (3) to paint up the names of streets and the numbers of houses or tenements on any private property; and

(2) by the insertion, immediately after section 57, of the following new section which shall have effect as section 57A: –

Naming of streets.

57A. The Minister shall, either of his own motion or on application made in that behalf by a Town Council, determine the name by which any street shall be known and in like manner at any time alter the name of any street.”

Insertion of” new section 57A in the Village Council Ordinance.

6. The following new section is hereby inserted, immediately after section 57, and shall have effect as section 57A, of the Village Councils Ordinance: –

“Naming of roads or paths.

57A. The Minister shall, either of his own motion or on application made in that behalf by a Village Council, determine the name by which any road or path shall be known and in like manner alter at any time the name of any road or path.”.

Control and erection of monuments.

7. No person shall erect a monument on any land belonging to the Republic or on any land vested in or belonging to any local authority except with the prior approval of the Minister granted upon an application made in that behalf by such person.

Naming of public parks, &c.

8. It shall not be lawful for any local authority to name any public parks, playground, library, reading room, stadium, building, clock tower, bridge or bathing-well except with the prior approval of the Minister.

Interpretation.

9. In this Law-

“Minister ” means this Minister in charge of the subject of Local Government ;

“Local authority ” means any Municipal Council, Urban Council, Town Council, Village Council and includes the River Valleys Development Board established under the River Valleys Development Board Act;

“monument: includes any statue, pillar, post, or any structure erected to commemorate any person whether living or dead but does not include any structure, tomb, or cross erected in any cemetery or burial ground.
