AN ACT TO AMEND THE NATIONAL HOUSING DEVELOPMENT AUTHORITY ACT, NO. 17 OF 1979

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:
|

Short title.
|
1. This Act may be cited as the National Housing Development Authority (Amendment) Act, No. 5 of 1982.
|
|
Amendment of section 6 of Act No. 17 of 1979.
|
2. Section 6 of the National Housing Development Authority Act, No. 17 of 1979, (hereinafter referred to as the “principal enactment”) is hereby amended in sub section (2) of that section by the substitution for the words “increased by a reasonable amount on account of improvements, if any, effected to such land, after that date.”, of the following :
|

increased by fifty per centum of the difference between that market value and
|
(a) in the case of any land or interest therein, in respect of which no Order under the proviso to section 38 of the Land Acquisition Act has been made, the market value, of the land or interest therein on the date of publication in the Gazette of the notice under section 7 of that Act; or
|
|
(b) in the case of any land or interest therein, in respect of which an Order under the proviso to section 33 of the Land Acquisition Act has been made, the market value of the land or interest therein on the date of publication of such Order.”.

Amendment of section 8 of the principal enactment.
|
3. Section 8 of the principal enactment is hereby amended by the addition, at the end of that section, of the following new subsection :
|
” (3) Nothing in the Prevention of Frauds Ordinance shall apply to any instrument of disposition effected under subsection (1) by or on behalf of the Authority.”.

Retrospective effect of amendments.
|
4. The amendments made in the principal enactment by the preceding provision of this Act shall be deemed to have taken effect on April 1, 1979.
