NORTH WESTERN ANIMAL HUSBANDRY STATUTE No. 04 OF 1998 NORTH WESTERN PROVINCIAL COUNCIL

A Statute to provide for efficient and effective maintenance of Animal Production and Health Services and other incidental matters thereto, in the North Western Province, while implementing the subjects pertaining to Animal Husbandry referred to in the Ninth Schedule, List 1, to the Constitution of the Democratic Socialist Republic of Sri Lanka
|

The North Western Provincial Council of the Democratic Socialist Republic of Sri Lanka hereby enacts as follows:
|
Short Title and Effective Date.
|
1. This Statute will be known as “North Western Animal Husbandry Statute, No. 04 of 1998 of the North Western Provincial Council” and will be effective from the date approved by the Governor, North Western Province.
|
PART INorth Western Animal Production and Health Department
Establishment of the Department.
|
2. A Department known as North Western Animal Production and Health Department is hereby established to achieve the objectives of the Statute.
|
Departmental Structure.
|
3.

|
(1) Provincial Director of Animal Production and Health referred to hereinafter as “Director” shall be the Head of the Department established under Section 2 herein.
|
|
(2) Provisions in Provincial Councils Act. No. 42 of 1987 will be applicable to appointment, transfer and disciplinary control of the staff required to perform the functions of the Department, and other matters incidental thereto.
|
|
(3) Institutions required to perform the role of activities of the Department shall be established a Provincial, District, Divisional and Rural levels.
|
|
(4) The Director may delegate any functions and powers required to perform such functions, vested in him, to one of his Deputy Directors or Assistant Directors appointed under provisions in Provincial Councils Act, No. 42 of 1987.
|
Objective
|
4. The objective of the Department shall be to promote Animal Production and Animal Health Services in the North Western Province.
|
Functions and Responsibilities
|
5. It shall be the responsibility of the Department to maintain properly the animal health, animal breeding, and animal husbandry project activities and training activities pertaining to such projects and to procure necessary management resources and the proper management of such resources in order to achieve the objectives of the Department while the Department’s main role in fulfilling the said responsibilities shall be to preserve, protect and improve animal resources, prevention and controlling of animal diseases, curing of sick animals and thereby promote animal production activities in the North Western Province.

Powers.
|
6. All powers necessary to achieve the objectives of the Department under this Statute are vested in the Head of the Department, subject to limits of the written law. Whenever the Director calls for any information pertaining to the performance of Department’s role of activities from the institutions, of the Provincial Council Local Government institutions, public organizations or individuals, such information should be provided by such institutions, organizations or individuals.

PART IIGeneral Provisions
|
(1) “The provisions of Provincial Council Act. No. 42 of 1997 shall be applicable in the provision and expenditure of financial provision required for the maintenance of institutions established under this Statue”.
|
|
(2) There should be no impediment in obtaining assistance in cash or kind from local and foreign sources for departmental activities, subject to the provisions in the written law.
|
|
(1) The Director should submit an Annual Administration Report to the Minister in charge of the subject, within six months from the expiry of each year and such report should describe the manner in which Animal Production and Health Services were conducted during the relevant year, related problems encountered, steps taken to find solutions to such problems and trends pertaining to animal health.
|
|
(2) Minister should present the Administration Report submitted under the above sub-section to the Provincial Council within a reasonable period of time.
|
Issuing of Directives.
|
9. Minister may issue special or general directives to the Director, in writing, with regard to execution of departmental powers and the Director should implement such directives.
|
|
(1) Minister may make orders pertaining to any matter, as directed by or empowered under this Statute and pertaining to matters given below :
|
(a) formulation of policies pertaining to animal husbandry ;
|
|
(b) obtaining assistance from foreign and local resources ;
|
|
(c) providing facilities to community engaged in animal husbandry.;
|
|
(d) conduct of urgent investigations ;
|
|
(e) remunerations and allowances;
|
|
(f) performance evaluation of institutions and services ;
|
|
(g) making provision for investigation of departmental activities.
|
|
|
(2) Every order made under sub section (1) should be published in the Gazette and it should be effective from the date of such publication or from the dale specified in the order.
|
|
(3) Every order made under sub-section (1) should be presented to the Provincial Council as early as possible for approval, after publication in the Gazette, and any order not approved by the Provincial Council shall be considered as cancelled effective from the date not approved. but such cancellation shall have no effect on any course of action already taken in compliance of such orders.

(4) The date considered as the date of cancellation of any such order, should be published in the Gazette.
|
Assets and Properties.
|
11. All such assets as properties or personnel engaged for the purpose of implementing the subject of Animal Production and Health or any form, notice, permit, register or any such document directed to be used on the date prior to the date of implementing this Statute, should be considered as assets and properties vested in the Department, transferred by the Government or received by any other mode, under this Statute.
|
PART III
Violating the Provisions of the Statute.
|
12. It shall be an offence under this Statute, subject to provisions in the written law. to violate provisions of this Statute or any orders made under this Statute or defaulting action under such provisions or obstructing any person in performing any function delegated under this Statute or orders made under this Statute.
|
Punishments.
|
13. Every person committing an offence under this Statute, when summarily convicted before a Magistrate, ‘ shall be liable to a fine not exceeding One Thousand Rupees or to imprisonment of either description for a period not exceeding two years or such fine or imprisonment both.
|
Inconsistency.
|
14. In the event of any inconsistency between the Sinhala and Tamil texts of this Statute, the Sinhala text shall prevail.
|
Interpretation.
|
15. In this Statute –
|
“Province” means North Western Province of the Democratic Socialist Republic of Sri Lanka,
|
|
“Provincial Council “means Provincial Council of the North Western Province,
|
|
“Governor” means the Governor of the North Western Province,
|
|
“Minister” means the Minister in charge of the subject of Animal Production and Health in the Provincial Council of the North Western Province,
|
|
“Director, Animal Production and Health” services means Director, Animal Production and Health appointed under the provisions of Provincial Councils Act No. 42 of 1987,
|
|
except in case a different interpretation becomes necessary.
|

Anthony Victor Perera, the Minister in charge of the subject of Fisheries and Co-operatives of North Western Provincial Council, do hereby delegate the powers vested with the Commissioner and the Register of Co-operative Development of the North Western Provincial Council, under the Provisions of the Co-operative Societies Act, No. 05 of 1972 as amended under the Provisions of the Co-operative Societies (Amendment) Act, No. 11 of 1992 and Act, No. 32 of !983 and the rules framed there under, thereafter as per Column III and from the date as per Column 11 to the persons named as per Column I, to assist the Commissioner and the Registrar of Co-operative Development of the North Western Province.
