Pensions (Special Provisions)
AN ACT TO PROVIDE FOR THE RECKONING OF THE SERVICES OF CIVILIAN EMPLOYEES AND EX-SERVICEMEN OF THE BRITISH GOVERNMENT OR IN THEIR BASES IN SRI LANKA FOR THE PURPOSE OF PAYING PENSION; AND FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO

Short title.

1. This Act may be cited as the Pensions (Special Provisions) Act, No. 30 of 1985.

Prior service to be reckoned for pension.

2. Notwithstanding anything in the Army Act (Chapter 357), Navy Act (Chapter 358), Air Force Act (Chapter 359), regulations made thereunder or the Minutes on Pensions

(a) service as a civilian employee under the British Government in the former British Services establishments in Sri Lanka; or

(b) service in the armed forces of the British Government or in their Bases in Sri Lanka,

from their date of employment or with effect from September 3, 1939, whichever is later shall be reckoned for the purposes of pension along with service in respect of which a pension is payable under such regulations or Minutes.

Revision of pension.

3. Where any person with civilian service or service in the armed forces of the British Government or in their Bases in Sri Lanka has retired and his pension computed without such service having been reckoned for the purpose of pension, such person’s pension shall be revised so as to confer the benefits in terms of section 2 of this Act.

Deduction of gratuity paid.

4. Where any gratuity has been paid under any regulation in respect of any person with civilian service or service in the armed forces of the British Government or in their Bases in Sri Lanka, such gratuity shall be deductible from any payment due to such person as commuted gratuity or pension as a result of such revision of his pension and credited to the Consolidated Fund.
