Provincial Of The Marist Brothers In Sri Lanka (Incorporation )
AN ACT TO INCORPORATE THE PROVINCIAL OF THE MARIST BROTHERS IN SRI LANKA.
Preamble.

WHEREAS the Marist Brothers in Sri Lanka have established themselves as a congregation for the purpose of spreading the knowledge of the Christian Religion, by establishing and maintaining Christian schools and other schools assisted or maintained by the State and by imparting educational and vocational training in the several parts of Sri Lanka:

AND WHEREAS it has become necessary for the aforesaid purposes to be more effectively Prosecuted, pursued and attained by the incorporation of the Provincial of the Marist Brothers in Sri Lanka:

AND WHEREAS it has become expedient to incorporate the said Provincial of the Marist Brothers in Sri Lanka:

BE it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows: –

Short title.

1. This Act may be cited as the Provincial of the Marist Brothers in Sri Lanka (Incorporation) Act, No. 16 of 1994.

Incorporation of the Provincial of the Marist Brothers in Sri Lanka.

2. From and after the date of commencement of this Act, the Provincial of the Marist Brothers in Sri Lanka to wit, the very Reverend Brother Uswatte Liyanage John Clifferd Jayantha Perera and his respective successors in office, duly appointed according to the laws and usages of the Roman Catholic Church, shall be a body corporate (hereinafter referred to as the ” Corporation “) under the name and style of ” The Provincial of the Marist Brothers “, with perpetual succession and full power to acquire, purchase, take, hold and enjoy movable and immovable property of every description and to sell or otherwise dispose of the same, and by that name, may sue and be sued in respect of such property in all courts.

General objects of the Corporation.

3. The objects of the Corporation shall be to spread the knowledge of the Christian Religion by establishing and maintaining christian schools and other schools assisted or maintained by the State and to engage in educational and vocational training in the several parts of Sri Lanka.

Saving of the rights of the Republic and others.

4. Nothing in this Act, contained shall prejudice and affect the rights of the Republic or of any body politic or corporate, or of any other persons except such as are mentioned in this Act, and those claiming by, from, or under, them.

Sinhala text to prevail in case of inconsistency.

5. In the event of any inconsistency between then Sinhala and Tamil text of this Act, the Sinhala text shall prevail.
