Railways (Amendment)


AN ACT TO AMEND THE RAILWAYS ORDINANCE.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Senate and the House of Representatives of Ceylon in this present Parliament assembled, and by the authority of the same, as follows: –
Short title.
1. This Act may be cited as the Railways (Amendment) Act, No. 20 of 1971.
Amendment of section 3 of Chapter 200.
2. Section 3 of the Railways Ordinance (hereinafter referred to as the ” principal enactment “) is hereby amended by the omission of the first proviso to that section.
Amendment of section 4 of the principal enactment.
3. Section 4 of the principal enactment is hereby amended by the substitution, for the words ” All such rules shall “, of the words ” All such rules, excepting rules relating to the charges to be made for the conveyance of passengers and goods by railway and the goods that are to be charged at special rates, shall “.
Insertion of new section 4A in the principal enactment.
4. The following new section is hereby inserted immediately after section 4, and shall have effect as section 4a, of the principal enactment: –

” Operation of rales relating to charges for conveyance of passengers and goods.
4A. Rules made by the Minister relating to the charges for the conveyance of passengers and goods by the railway shall be published in the Gazette and shall come into operation on such date as may be specified therein.”.
Amendment of the Schedule to the principal enactment.
5. The Schedule to the principal enactment is hereby amended as follows: –

(1) under the heading ” Passengers “-

(a) by the repeal of paragraph 1; and
(b) by the renumbering of paragraphs 2, 3, 4, 5 and 6 as paragraphs 1, 2, 3, 4 and 5 respectively; and
(2) under the heading ” Goods ”

(a) by the repeal of paragraph 1; and
(b) by the renumbering of paragraphs 2, 3, 4, 5, 6 and 7 as paragraphs 1, 2, 3, 4, 5 and 6 respectively.
