Ratnapura District Welfare Fund (Board Of Trusteees)
AN ACT TO INCORPORATE THE BOARD OF TRUSTEES OF THE RATNAPURA DISTRICT WELFARE FUND.

WHEREAS a Fund called and known as the Ratnapura preamble. District Welfare Fund has heretofore been established at Ratnapura for the provision of funds for the achievement of the several objects for which the said Fund was established :

And Whereas the affairs and objects of the said Fund have heretofore been managed and carried out by a Board of Trustees:

And Whereas the said Board of Trustees has applied to be incorporated and it will be for the public advantage to grant the application :

Be it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows :-

Short title.

1. This Act may be cited as the Ratnapura District Welfare Fund (Board of Trustees) Act, No. 56 of 1981.

Incorporation of the Board of Trustees of the Ratnapura District Welfare Fund.

2. From and after the date of commencement of this Act, the members for the time being of the Board of Trustees of the Ratnapura District Welfare Fund (hereinafter referred to as “the Fund”) shall be a body corporate (hereinafter referred to as “the Board”) with perpetual succession and the name ” The Board of Trustees of the Ratnapura District Welfare Fund “. The Board may sue and be sued in such name and may have and use a common seal and alter the same at its pleasure.

Constitution of the board, &c.

(1) The administration, management and control of the Fund shall be vested in the Board which shall consist Board, of the following members :-

(a) the District Minister for the Administrative District of Ratnapura, who shall be the Chairman of the Board;

(b) the Government Agent for the Administrative District of Ratnapura, who shall be the Secretary of the Board ;

(c) two persons to be nominated by the District Minister for the Administrative District of Ratnapura ;

(d) the Regional Director of Education, Ratnapura ;

(e) the Assistant Director of Social Services, Ratnapura ;

(f) the Assistant Director of Local Government, Ratnapura; and

(g) the Accountant of the Kachcheri, Ratnapura, who shall be the Treasurer of the Board.

(2) Each member of the Board nominated under paragraph (c) of subsection (1) shall hold office for a period of two years from the date of his nomination, and shall be eligible for renomination at the end of the term of his office

(3) Meetings of the Board shall be held at least once in every six months. The Secretary shall give five calendar days’ notice in writing of every such meeting to the members :

Provided however that the Secretary shall have the power to summon a special meeting of the Board, with three calendar days’ notice in writing at any time, if he is of opinion that it is necessary that the Board should meet.

(4) The quorum for a meeting of the Board shall be five.

Constitution of the Fund.

4. The Fund shall consist of-

(a) all moneys lying to the credit of the Fund on the date of commencement of this Act; and

(b) all moneys that may accrue to the Fund after the date of commencement of this Act.

Purposes for which the moneys of the fund may be applied.

5. It shall be the duty of the Board to apply the moneys belonging to the Fund for the purposes hereinafter pro vided in such manner as the Board may determine-

(a) for the promotion of Buddhist activities ;

(b) for assisting the activities of Hindu, Muslim, Christian and other religious organizations with a view to bringing about goodwill and harmony among all religious groups ;

(c) for the promotion of the general welfare of children;

(d) for the advancement and promotion of national arts and crafts giving first preference to the advancement and promotion of such arts and crafts in the Ratnapura District;

(e) for the promotion of sports activities ; and

(f) for any other purpose, which is in the opinion of the Board, of benefit or interest to the people of the Ratnapura District.

Powers, duties functions of the Board.

(1) The Board shall have the power to do all things as are necessary for, or conducive or incidental to, the giving effect to the provisions of this Act.

(2) Without prejudice to the generality of the powers conferred by subsection (1), the Board may exercise and discharge the following powers and functions :-

(a) to raise funds or receive grants, gilts or donations in cash or kind ;

(b) to acquire in any manner whatsoever and hold, take or give on lease or hire, mortgage, pledge, sell or otherwise dispose of, any movable or immovable property ;

(c) to engage, employ and remunerate such officers and servants as may be necessary for the administration of the Fund ; and

(d) to invest any moneys belonging to the Fund in any such investments as the Board may determine.

Bank accounts.

7. The Board shall maintain the accounts of the Fund in either of the following Banks :-

(a) the Bank of Ceylon, Ratnapura : or

(b) the People’s Bank, Ratnapura.

Rules.

8. Subject to the provisions of this Act, rules may be made by the Board in respect of all or any of the following! matters :-

(a) the procedure to be followed, and the transaction of business, at meetings of the Board ;

(b) the powers, conduct, duties and functions of the members of the Board and the officers and servants of the Board ; and

(c) the administration and management of the property of the Fund, the custody of its funds and the maintenance and audit of its accounts and the affixing of its seal.
