Registration Of Persons (Amendment)


AN ACT TO AMEND THE REGISTRATION OF PERSONS ACT , NO. 32 OF 1968.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the House of Representatives of Ceylon in this present Parliament assembled, and by the authority of the same, as follows:-
Short title.
1. This Act may be cited as the Registration of Persons (Amendment) Act, No. 37 of 1971.
Amendment of section 2 of Act No. 32 of 1968.
2. Section 2 of the Registration of Persons Act, No. 32 of 1968, hereinafter referred, to as the ” principal Act “, is hereby amended as follows: –

(1) in. paragraph (c) of sub-section (1) of that section, by the substitution, for the words and figures ” section 15 of that Act, “, of the words and figures ” section 15 of that Act; or;
(2) by the addition, immediately after paragraph (c) of sub-section (1) of that section, of the following new paragraph: –

” (d) who is liable to removal to India from Ceylon under section 15 of the Indo-Ceylon Agreement (Implementation) Act, No. 14 of 1967, “;
(3) in paragraph (b) of sub-section (2) of that section, by the substitution, for the words and, figures ” section 2 (1) of that Act. ” of the words and figures ” section 2 (1) of that Act; or “; and
(4) by the addition, immediately after paragraph (b) of sub-section (2) of that section, of the following new paragraph: –

” (c) a person, who is the holder of a valid residence permit issued under the Indo- Ceylon Agreement (Implementation) Act, No. 14 of 1967.”.
Amendment of section 9 of the principal Act.
3. Section 9 of the principal Act Is hereby amended as follows: –

(1) in sub-section (2) of that section by the deletion of paragraph (d) of that sub-section; and
(2) in sub-section (4) of that section by the omission of the words and figures ” to take the impressions referred to in paragraph (d) of sub-section (2), and “, and by the substitution, for the expression ” that sub-section. “, of the expression ” sub-section (2). “.
Amendment of section 10 of the principal Act.
4. Section 10 of the principal Act Is hereby amended in paragraph (b) of sub-section (1) of that section by the addition,-

(1) Immediately after the words ” or paragraph (c) “, of the words ” or paragraph (d) “: and
(2) immediately after the words ” or paragraph (a) or paragraph (b) “, of the words ” or paragraph (c) “.
Amendment of section 16 of the principal Act.
5. Section. 16 of the Principal Act is hereby amended by the deletion of sub-section (4) of that section.
Amendment of section 17 of the principal Act.
6. Section 17 of the principal Act is hereby amended as follows: –

(1) in sub-section (2) (c) of that section by the addition immediately after the words ” standard’s and quality “, of the words ” and the original of that card “; and
(2) by the deletion of sub-section (5) of that section.
Amendment of section 44 of the principal Act.
7. Section 44 of the principal Act is hereby amended in sub-section (1) of that section as follows:-

(1) in paragraph (c) of that sub-section, by the substitution, for the words ” one such application, “, of the words ” one such application; or “; and
(2) by the addition, immediately after paragraph (c) of that sub-section, of the following new paragraphs:-

” (d) obtains an identity card by fraud; or
(e) notwithstanding the provisions of sections 24 and 47, obtains by fraud or otherwise or is in possession of or uses more than one identity card,”.
Amendment of section 46 of the principal Act.
8. Section 46 of the principal Act is hereby amended by the addition, immediately after subsection (2) of that section, of the following new subsection: –

” (3) The provisions of this Act shall be without prejudice to the operation of the Indo-Ceylon Agreement (Implementation) Act, No. 14 of 1967, and accordingly the fact that a person has applied for registration or is registered in the Register of Persons or is the holder of an identity card shall not in any way affect the liability of that person for removal to India from Ceylon under section 15 of that Act, “.
Amendment of section 52 of the principal Act.
9. Section 52 of the principal Act is hereby amende in sub-section (2) of that section by the deletion of paragraph (c) and paragraph (d) of that sub-section.
Amendment of section 55 of the principal Act.”
10. Section 55 of the principal Act is hereby amended by the deletion of the definition of the expression ” appropriate identifying mark”.
