AN ACT TO PROVIDE FOR THE VESTING IN APPROPRIATE AUTHORITIES OF THE CONTROL OF REST HOUSES, AND FOR THE LETTING, USE, AND OCCUPATION OF REST HOUSES,

Short title,

1. This Act may be cited as the Rest houses Act.

Control of rest houses to be vested in Government Agents, or Municipal or Urban Councils.

(1) The control of every rest house situated within the administrative limits of any Municipal Council or Urban Council shall be vested in the Council.

(2) The control of every rest house (other than a rest house referred to in subsection (H) shall he vented in the Government Agency of the administrative district in which that rest house is situated.

Transfer of control of rest houses.

(1) The Minister may by Order published in the Gazette transfer the control of any rest house to. and vest such control in. such appropriate authority as may be specified in the Order- Every such Order shall specify the date on which it shall take effect.

(2) An Order may be made under subsection (I) in respect of any rest house, from time to time, as occasion may require. and shall have effect notwithstanding anything in section 2 or in any Order previously made under subsection (1) of this section,

Rest house rules

(1) The appropriate authority, not being the Director of the Government Tourist Bureau, in whom the control of any rest house is vested by or under this Act may make such rules as may appear expedient to the authority in respect of the maintenance, use and occupation of the rest house of the fees and charges to be made for use and occupation and for services provided, and of the conduct of persons using or occupying the rest house.

(2) No such rules shall come into force unless they have been approved by the Minister and published in the Gazette.

(3) All rules made under this section in respect of any rest house shall! he binding in law upon all persons in any manner using or occupying the rest house or its premises.

(4) All rules made in respect of any rest house under section 15*(*This is a reference to the section 15 which was repealed by Act No. 1 I of l951.) of the Thoroughfares Ordinance, No. 10 of 1861, and all by-laws made or deemed to have been made in respect of an resellers under the Urban Councils Ordinance or [he Municipal Councils Ordinance, and in force immediately prior to the appointed date, shall be deemed to be rules made by the appropriate authority under the preceding provisions of this section, and may accordingly be amended, added to or repealed by that authority.

(5) Where the control of any rest house is transferred to any appropriate authority by an Order under section 3, the rules in force in respect of that rest house immediately prior to the date on which the transfer takes effect shall be deemed to be rules made by that authority under the preceding provisions of this section, and may accordingly be amended, added to or repealed by that authority.

Letting of rest ho uses.

(1) The appropriate authority in whom the control of any rest house is vested by or under this Act may, with the approval of the Minister, let to any other person the right to maintain the rest house upon such terms and conditions (including the making of payments by way of rent or otherwise), as may be approved by the Minister.

(2) Notwithstanding the letting of any rest house as provided in subsection (I), the provisions of section 4 and of any rules made or deemed to be made thereunder shall continue to have effect in relation to that rest house.

Financial provisions.

(1) All sums received by any local authority under or by virtue of any rules made or deemed to be made under section 4 in respect of any rest house in its control, or under section 5 in respect of the letting of any such rest house, shall be credited to the funds of that authority ; and all expenditure incurred by that local authority in respect of the maintenance, administration, control or advertisement of the rest house shall be defrayed out of such funds.

(2) All sums received by any public officer under or by virtue of any rules made or deemed to be made under section 4 in respect of any rest house in his control or under section 5 in respect of the letting of any such rest house shall be credited to the Consolidated Fund; and all expenditure incurred by such officer in respect of the maintenance, administration, control or advertisement of the rest house shall be paid out of the Consolidated Fund from moneys provided by Parliament for the purpose.

Interpretation.

7. In this Act “appointed date” means the 1st day of April, 1951;

” appropriate authority” includes any public officer (whether a Government Agent or not), any local authority, and any body of persons incorporated by Act or Ordinance

“local authority ” includes any Municipal Council, Urban Council or Town Council;

” rest house” means a public rest house, and includes any premises appertaining to any rest house, and any ambalama, maddum or other public buildings for the shelter of travellers.
