AN ACT TO PROVIDE FOR THE EXERCISE OF THE POWERS NOW VESTED IN THE DEPARTMENT OF HIGHWAYS BY THE ROAD DEVELOPMENT AUTHORITY ; TO MAKE CONSEQUENTIAL AMENDMENTS TO THE ROAD DEVELOPMENT AUTHORITY ACT ; AND FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO.

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows :
|
|

Short title.
|
1. This Act may be cited as the Road Development Authority (Special Provisions) Act, No. 5 of 1988.
|
|
Powers, functions and duties of the Department of Highways or the Department of the Director of Works to be exercised, performed and discharged by the Road Development Authority established by Act, No. 73 of 1981.
|
2. From and after the coming into force of this Act”
|
(a) all roads and thoroughfares to which the Thorough- fares Ordinance applied prior to the corning into force of this Act, shall vest in the Road Development Authority, established by the Road Development Authority Act, No. 73 of 1981 (hereinafter referred to as the ” Authority “) ;
|

(b) every power, duty and function, conferred or imposed on, or assigned to, the Department of Highways or the Department of the Director of Works by the Thoroughfares Ordinance, or any other law shall be exercised, performed or discharged by the Authority ; and
|
|
(c) every power, duty and function conferred or imposed on, or assigned to, an officer specified in Column I of the Schedule to this Part by the Thoroughfares Ordinance or any other law, shall be exercised, performed or discharged by such officer of the Authority as is specified in the corresponding entry in Column II of that Schedule.

Road deemed to be in charge of Authority if maintained from the Fund of the Authority.
|
3, For the purposes of the Thoroughfares Ordinance, a road shall be deemed to be in charge of the Authority, if it is maintained from the Fund of the Authority and a certificate under the hand of the General Manager to the effect that any road is maintained by the Authority shall be prima facie evidence of the fact that the road is so maintained.

Amendment of section 9 of Act No. 73 of 1981.
|
4. Section 9 of the Road Development Authority Act, No. 73 of 1981 (hereinafter referred to as the “principal enactment”) is hereby amended by the insertion immediately after subsection (2) thereof, of the following new-subsection : ”
|
” (3) For the avoidance of doubts it is hereby declared that the Authority may exercise, perform and discharge, any power, duty or function conferred or imposed on, or assigned to the Authority by any other law.”.
|

Amendment of section 11 of the principal enactment.
|
5. Section 11 of the principal enactment is hereby amended by the substitution for the words, ” powers, duties or functions under this Act”, of the words ” powers, duties or functions conferred or imposed on, or assigned to the Authority by this Act or any other law “.
