Small Tenements (Repeal) AN ACT TO REPEAL THE SMALL TENEMENTS ORDINANCE (CHAPTER 102) AND TO PROVIDE FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO. BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the House of Representatives of Ceylon In this present Parliament assembled, and by the authority of the same, as follows: – Short title. 1. This Act may be cited as the Small Tenements (Repeal) Act, No. 41 of 1971. Repeal of the Small Tenements Ordinance (Chapter 102). 2. The Small Tenements Ordinance (Chapter 102) is hereby repealed. Pending actions. 3. Notwithstanding anything in any other law,- (a) any application filed in any court, under the Small Tenements Ordinance, for the recovery of possession of any tenement or part thereof shall, if such application is pending on the date of commencement of this Act, be deemed at all times to have been and to be null and void; and (b) proceedings shall not be taken for the execution of any writ of possession issued by any court on any such application as is referred to in paragraph (a), and where such proceedings have begun before the date of commencement of this Act but have not been completed on such date, such proceedings shall not be continued, and shall be deemed to have abated.
