Superior Major Of The Silvestro-benedictine Congregation In Sri Lanka(Incorporation)

WHEREAS it is expedient for the purposes hereinafter set out only to incorporate the Superior Major of the Silvestro-Benedictine Congregation in Sri Lanka :

Be it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:

1.This Act may be cited as the Superior Major of the Silvestro-Benedictine Congregation in Sri Lanka (Incorporation) Act, No. 41 of 1981.

2. From and after the date of commencement of this Act, the Superior Major of the Silvestro-Benedictine Congregation in Sri Lanka, to wit, the very Reverend Father Thomas de Zylva, O.S.B-, and his respective successor or successors duly appointed according to the laws and customs of the Roman Catholic Church shall be and become a corporation with perpetual succession under the name and style of ” The Superior Major of the Silvestro- Benedietine Congregation in Sri Lanka”, and shall have full power to acquire by purchase, gift, devise, bequest or otherwise, and to hold and enjoy, movable or immovable property of every description, and to sell or otherwise dispose of the same, and by that name shall and may sue and be sued in respect of such property in all courts.

3. All property, both movable and immovable, already acquired, held or possessed by the Bishop of Kandy in trust for the Silvestro-Benedictine Congregation in Sri Lanka, is hereby vested in the Corporation, subject to the like trusts, conditions or restrictions affecting the same immediately prior to the date of commencement of this Act.

4. In the event of the death of the Superior Major of the Silvestro-Benedictine Congregation in Sri Lanka, or in the event of his inability to attend to his duties whether through infirmity or prolonged absence or any other cause, his Counselor who is the senior most in the order of admission to the Silvestro-Benedictine Congregation in Sri Lanka, shall be deemed to be the Superior Major for all the purposes of this Act until the appointment of a new Superior Major or, until the resumption of the duties by the Superior Major, as the case may be.

5.Nothing contained in this Act shall prejudice or affect the rights of the Republic or any body politic or corporate or of any other persons except such as are mentioned in this Act-
