TEA RESEARCH
AN ORDINANCE TO PROVIDE FOR THE ESTABLISHMENT OF A TEA RESEARCH INSTITUTE AND FOR THE INCORPORATION OF THE BOARD OF MANAGEMENT THEREOF.

Short title.

1. This Ordinance may be cited as the Tea Research Ordinance.

Establishment of Tea Research Institute.

2. An institute, styled ” The Tea Research Institute of Ceylon”, shall be established in Ceylon for the purpose of research into and investigation of all problems and matters relating to tea and the provision and publication of information relating to the same, and shall provide such facilities for the education of students in tea research as the Minister[1] may from time to time direct.

Incorporation of board.

(1) The institute shall be under the control and management of a board to be styled ” The Board of the Tea Research Institute of Ceylon”, in this Ordinance called the board.

(2) The board shall be a body corporate having perpetual succession and a common seal and may sue and be sued in all courts by the name of ” The Board of the Tea Research Institute of Ceylon “.

(3) The board may acquire and hold property, movable and immovable, and may sell, transfer, lease, mortgage, or otherwise dispose of the same, contract and do all things necessary for or incidental to the purposes of its constitution.

4. The headquarters of the board shall be at St. Coombs Estate, Talawakelle, or at such other place as may be appointed by the Minister in that behalf.


Constitution of the board.

(1) The following persons shall be members of
the board : –

(a) Ex Officio members-

The Director of Agriculture.

The Minister of Finance or his representative.[1]

The Chairman of the Planters’ Association of Ceylon.

The Chairman of the Agency Section of the Planters’ Association of Ceylon.

(b) Nominated members-

Three members nominated by the General Committee of the Planters’ Association of Ceylon.

Three members nominated by the Low-country Products Association of Ceylon.

Two persons nominated by the Minister to represent the small holders.

One member of the House of Representatives nominated by the Minister.

(2) Nominated members shall hold office for three
years, but may be renominated from time to time.


Vacation of membership through absence.

6. Any member nominated under section 5 (1) (b) who is absent without reasonable cause from three ordinary consecutive meetings of the board may, by resolution of the board passed at any ordinary meeting of which notice has been duly given, be held to have vacated his office.


Death or resignation of member.

7. Upon the death, resignation, or the termination or vacation of office of any member of the board, a new member may be nominated in accordance with the provisions of section 5.


Acting
appointments.

8. If any nominated member shall be unable or unwilling to act or shall be absent from Ceylon, the body which nominated him may appoint any other person to be a nominated member during the inability or unwillingness of such first-mentioned member to act or during his absence from Ceylon.


Chairman.

9.

(1) The board shall elect its own chairman.

(2) In the absence of the chairman from any meeting of the board, a chairman for such meeting shall be chosen by the members present.


Meetings and quorum.

10.

(1) The chairman shall summon meetings of the board when necessary, and shall at any time summon a meeting upon receipt of a request signed by two members of the board calling upon him to do so.

(2) Five members shall form a quorum. All questions shall be decided by a majority of members voting. In the case of equality of votes, the chairman shall have a second or casting vote, and all matters decided at a meeting of the board shall be recorded in a proceedings book kept by the secretary to the board. Matters may also be decided by the circulation of papers, on which members of the board may record their votes, and all such decisions shall be reported to the next meeting of the board and incorporated into the proceedings book.

11.

(1) In order to provide an annual income for the board, there shall be charged, levied, and paid, in addition to the export duty charged under the Customs Ordinance, an export duty of fifty-five cents per one hundred pounds of tea exported and so in proportion for any less weight, the proceeds of which shall be paid over monthly to the board by the Principal Collector of Customs, no part thereof being credited to the Consolidated Fund.[1]

(2) This section shall have effect as though it formed part of the Customs Ordinance.

12.

(1) The board shall have full power and authority generally to govern, direct, and decide all matters connected with the appointment of officers and servants of the institute and the administration of its affairs and the accomplishment of its objects and purposes.

(2) All moneys raised for the general purposes and objects of the institute shall be paid to the board and shall be applied by the board in its discretion to the accomplishment of such objects and purposes.

13. The board may establish and maintain a provident fund for the benefit of all or any of its officers and servants, make contributions out of the moneys at its disposal to that fund, regulate the management and investment thereof, and prescribe the contributions to be made thereto by, and payments to be made therefrom to, such officers and servants.


Accounts.

14. Within one month after each thirty-first December the board shall cause to be prepared a statement of the receipts and disbursements during the previous year, and the same shall be subject to such audit and published in such manner as the Minister[1] may direct, and a full report of the work of the board, with the said statement of the receipts and disbursements, shall be laid on the table of the Senate and the House of Representatives.[1]
