AN ACT TO INCORPORATE THE INTERNATIONAL SOCIETY FOR KRISHNA CONSCIOUSNESS (ISKON)-SRI LANKA BRANCH.
Preamble

WHEREAS an Association called and know as “The International Society for Krishna Consciousness(Iskon)-Sri Lanka Branch” has heretofore been established at Colombo in Sri Lanka for the purpose of effectually carrying out and transacting all matters connected with the said Association according to the rules agreed to by its members;

AND WHEREAS the said Association has heretofore successfully carried our and transacted the several objects and matters for which it was established and has applied to be incorporated and it will be for the public advantage to grant such application:

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows:-

Short title.

1. This Act may be cited as the International Society for Krishna Consciousness (Iskon)-Sri Lanka Branch (Incorporation) Act,No.69 of 1992.

Incorporation of International Society for Krishna Consciousness (Iskon)-Sri Lanka Branch.

2. From and after the commencement of this Act, such and so many persons as now are members of the International Society for Krishna Consciousness (Iskon)-Sri Lanka Branch (hereinafter referred to as “the Association”) or shall hereafter be admitted as members of the Corporation hereby constituted, shall be a body corporate (hereinafter referred to as ” the Corporation”) with perpetual succession under the name and style of “the International Society for Krishna Consciousness(Iskon) -Sri Lanka Branch” and by that name may sue and be sued, with full power and authority to have and to use a common seal and to alter the same at its pleasure.

General Objects of the Corporation.

3. The general objects for which the Corporation is constituted are hereby declare to be-

(a) to systematically propagate spiritual knowledge to society at large and to educate all people in the technique of spiritual life in order to check the technique of spiritual life in order to check the imbalance of values in life and to strive to achieve real unity and peace in the world by following and propagating the teachings of His Divine Grace A.C Baktivedanta Swami Prabhupada, founder of the International Society for Krishna Consciousness;

(b) to propagate a consciousness of Krishna, as revealed in Bhagavad-Gita and Srimad-Bhagavatam:

(c) to bring the members of the Corporation together and nearer to Krishna, thus developing the idea within the members, and humanity at large, that each soul is part and. parcel of the quality of the Godhead (Krishna) ;

(d) to teach and encourage the Sankirtana Movement (congregational chanting of the holy names of God) as revealed in the teachings of Lord Sri Chaitanya Mahaprabhu;

(e) to erect for the members and for society at large holy place of transcendental worship, dedicated to the Personality of Krishna ;

(f) to encourage members to adopt a simpler, more natural way of life ;

(g) to publish and distribute, periodicals, books and other writings.

General power of the Corporation.

4. Subject to the precisions of this Act and any other written law, the Corporation shall have the power to dot perform and execute all such acts, matters and things whatsoever as are necessary or desirable for the promotion or the furtherance of the objects of the Corporation or any one of them including the power to open, operate and close bank accounts, to borrow or raise moneys with or without security, to receive or collect grants and donations, to invest its funds and to engage, employ and dismiss officers and servant required for the carrying out of the objects of the Corporation,

Management of the affairs of the Corporation.

(1) The affairs of the Corporation shall, subject to the rules in force for the time being of the Corporation, be administered by a Board of Management consisting of the office bearers and such other persons as may be provided for by the rules and elected in accordance with the said rules.

(2) The first, Board of Management at the Corporation shall be the Board of Management of the Association holding office on the day Immediately preceding the date of commencement of this Act.

Rules of the Corporation.

(1) It shall be lawful for the Corporation from lime to time at any general meeting of the members and by the votes of not less than two thirds of the members present and voting, at such meeting to make rules not inconsistent with the provisions of this Act or any other written law, for the admission, withdrawal or expulsion of members for the conduct of the duties of the board of Management of the Corporation and of the various officers, agents and servants of the Corporation, for the procedure to foe followed in the transaction of business, at the meeting of the Corporation and otherwise generally, for the management of the affairs of the Corporation and the accomplishment of its objects. Such rules when made may, at a like meeting and in like manner be altered, added to, amended or cancelled:

Provided however that no such alteration, addition. amendment or cancellation shall have effect unless approved by the Board of Management.

(2) The members of the Corporation shall be subject to the rules of the Corporation.

Corporation may hold property movable and immovable.

7. The Corporation shall be able and capable in law to acquire and hold any property, movable or immovable, which hold may become vested In it by virtues of any purchase, grant, property gift, testamentary disposition or otherwise and all such property shall be held by the Corporation for the purposes of this Act and subject to the rules in force for the time being of the Corporation, with full power to sell, mortgage, lease, exchange or otherwise dispose of the same.

Debts due and payable by the Association.

8. All debts and liabilities of the Association existing on the day immediately preceding the date of commencement of this Act, shall be paid by the Corporation hereby constituted and all debts due to and subscriptions and contributions payable to the Association on that day, shall be paid to the Corporation for the purposes of this Act.

How the seal of the Corporation is to be affixed.

9. The seal of the Corporation shall not be affixed to instrument whatsoever except, in the presence of the President and Secretary or Treasurer who shall sign their name to the instrument in taken of their presence and such signing shall be independent of the signing of any persons. as a witness.

Application at the Funds of the Corporation.

10. The income and property of the Corporation how so ever derived shall be applied solely towards the promotion of the objects of the Corporation as set forth in this Act and in no event shall the assets belonging to the Corporation be taken outside the limits of Sri Lanka or used for any purposes outside the said limits or contrary to the conditions of any trust under which the property is received.

Decision or Dispute and as to principles or policy.

11. Subject to the provisions of this Act or any other written law, any dispute or doubt as to any matter or question affecting or relating to the principles or policy of the Corporation shall be referred to the Commissioner of the Governing Body for Sri Lanka in India, whose decision thereon shall be final.

Saving of Rights of the Republic and other.

12. Nothing in this Act shall affect the rights of the Republic or of any body politic or corporate or of any other person except such as are mentioned in this Act and those claiming by, from, or under, them,

Sinhala text to prevail in case of Inconsistency.

13. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
