Short title.
|
1. This Act may be cited as the World Buddhist Peace Foundation (Incorporation) Act. No. 51 of 1991.
|
|
Incorporation of the World Buddhist Peace Foundation.
|
2. From and after the date of commencement of this Act, such and so many persons as now are members of the World Buddhist Peace Foundation (hereinafter referred to as the ‘Foundation”) or shall hereafter be admitted members of the Corporation hereby constituted shall be a body corporate (hereinafter referred to the ” Corporation “) with perpetual succession, under the names and style of the ” World Buddhist Peace Foundation ” and by that name may sue, and be sued, in all courts, with full power and authority to have, and to use. a common seal and to alter the same at its pleasure.

General objects of the corporation.

3. The general objects for which the Corporation is constituted are hereby declared to be”
|
(a) to communicate the message contained in the teachings of Lord Buddha and to propagate Buddhist culture, with a view to promoting world peace;
|
|
(b) to present the Buddhist point of view on any matter, on behalf of the Buddhist community of the world. at conferences and seminars on global problems relating to education, culture, communications, survival, development and peace, convened by any international, governmental or non-governmental organization whether religious or secular :
|
|
(c) to initiate, co-ordinate and assist studies on problems of survival, development; peace, education and culture, from a Buddhist perspective and to publish the results of such studies ;

|
(d) to provide facilities for Buddhist leaders and scholars of the world to meet and discuss the problems referred to in paragraph (c) and to plan appropriate remedial measures ;
|
|
(e) to function as a documentation centre for peace oriented Buddhist study groups, meditation groups, mass media groups and action groups, and to provide for the exchange of information and the sharing of experiences ;

|
(f) to establish a library, containing books, research reports, periodicals, other documents, audio visual aids, films end cassettes ;
|
|
(g) to hold seminars, workshops, conferences and orientation courses for young persons and youth leaders, on mental health, personality development, national integration and world peace with a Buddhist perspective based on wisdom and compassion (Panna Karuna);
|
|
(h) to work in collaboration with the World Fellowship of Buddhist and other religious and secular international organizations whether governmental or non-governmental for the promotion of world peace ;
|
|
(i) to make comparative studies of religious philosophies and of the Buddhist philosophy of education and other modern philosophies of education, for the purpose of evolving a theory of education relevant to contemporary society.

|
General Powers of the Corporation.
|
4. Subject to the provisions of this Act and any other written law, the Corporation shall have the power to do, perform and execute all such acts, matters, and things whatsoever, as are necessary or desirable for the promotion or furtherance of the objects of the Corporation or any one of them, including the power to open, operate and close bank accounts, to borrow or raise money, with or without security. to receive or collect grants and donations from local or foreign sources, to invest its funds, and to engage, employ and dismiss such officers and servants as are required for the purpose of carrying out the objects of the Corporation

Board of Directors of the Corporation.

(1) The management and administration of the affairs of the Corporation shall, subject to the rules of the Corporation, be vested in a Board of Directors (hereinafter referred to as the ” Board “) consisting of not more than twenty-five members to be elected by the general body in accordance with the rules of the Corporation.

(2) The Board may delegate any of its functions to an Executive Council consisting of the President, Secretary and Treasurer and not more than four other members of the Board, elected or appointed in accordance with the rules of the Corporation, and such Council shall discharge the functions in accordance with the directions of the Board.
|

(3) The first Board of the Corporation shall be the Board of Directors of the Foundation holding office on the day preceding the date of commencement of this Act.
|
|
|
Rules of the Corporation.
|

(1) It shall be lawful for the Corporation from time to time at any general meeting of the members convened by the Board, and by a majority of votes or not less than two-thirds of the members present and voting, to make rules not inconsistent with the provisions of this Act, or any other written law for the admission, withdrawal or expulsion of members for the election of office bearers, the Board, the Executive Council and Project Committees, for the conduct of the duties of the various officers, agents and servants of the Corporation, for the procedure to be followed in the transaction of business by the Board, and otherwise generally, for the management of the affairs of the Corporation and the accomplishment of its objects. Such rules when made may at a like meeting and in like manner be altered, added to. amended or resinded.

(2) The members of the Corporation shall be subject the rules of the Corporation.
|
|
|
Corporation may hold property movable and immovable.
|
7. The Corporation shall be capable in law to take; and hold any property, movable or immovable, which may be vested in it by virtue of any purchase, grant, gift. testamentary disposition or otherwise, and all such property shall be held by the Corporation for the purposes of this Act and subject to the rules of the Corporation, with full power to sell, mortgage, lease, exchange or otherwise dispose of the same.

Debts due by and payable to the Foundation.
|
8. All debts and liabilities of the Foundation existing on the day preceding the date of commencement of this Act, shall, be paid by the Corporation, and all debts due to and subscriptions and contributions payable to. the Foundation on that day shall be paid to the Corporation for the purposes of this Act.

How the seal of the Corporation is to be affixed.
|
9. The seal of the Corporation shall not be affixed to any instrument whatsoever, except in the presence of such number of persons as may be provided for in the rules of the Corporation, who shall sign their name on the instrument in token of their presence, and such signing shall be independent of the signing of any person, as a witness.

Saving of the rights of the Republic and others.
|
10. Nothing in this Act contained shall prejudice or affect the rights of the Republic, or any body politic or corporate or of any other persons except such as are mentioned, in this Act and those claming by from, or under them.
|
|
Sinhala text to prevail, in case of inconsistency.
|
11. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
