Transfer of Court Fines Draft Statute

TRANSFER OF COURT FINES/STATUTE OF THE NORTH WESTERN PROVINCE No………….OF 1994

A STATUTE TO PROVIDE FOR THE TRANSFER OF FINES AND PENALTIES IMPOSED BY COURTS AND COLLECTED UNDER THE FINANCE STATUTE OF THE NORTH WESTERN PROVINCE NO. 1 OF 1992 TO THE LOCAL AUTHORITIES IN THE NORTH WESTERN PROVINCE

 

BE it passed by the Provincial Council of the North Western Province as follow.

 

Short Title.
1. This Statute may be cited as the Transfer of Court Fines Statute of the North Western Province No……. “of 1994.

 

Transfer of Court Fines and Penalises.
2. Where the Provincial Council has collected, in terms of the Finance Statute of the North Western Province, No. 1 of 1992 as amended, the fines and penalties imposed by Courts Situated in the Province, the Provincial Council may Transfer the amount of such fines and Penalties to the relevant local authority on a claim, in writing, by the Chief Administrative Officer of such Local Authority to the Minister of the Board of Ministers in charge of the Subject of finance of the Province, made within a period of two years from the thirty-first day of December of the year in which such fines and penalties were collected as aforesaid.

 

Certificate of the Registrar of the Court.
3. No claim under Section 2 shall be valid unless accompanied with a schedule of payment of such fines and penalties specified in the claim specifying the date of such payment, the date of remittance of such amount by the relevant court to the Provincial Council and the Ordinance or the Act under which such fines and penalties have been imposed with particular reference to the Schedule thereof and certified by the Registrar of the court which imposed and charged such fines and penalties or any other officer nominated by him on that behalf.

 

Interpretation

4. In this Statute, unless the context otherwise requires. “Chief Administrative Officer” means –

(a) in relation to a Municipal Council, the Municipal Commissioner.; and
(b) in relation to an Urban Council or a Pradeshiya Saba, the Secretary thereof;
“Local Authority” means any Municipal Council, Urban Council, or Pradeshiya Saba and includes any , authority created and established by or under any law to exercise, perform and discharge powers, duties and functions corresponding to or similar to the powers, duties and functions exercised, performed and discharged by. any such Council or Sabha; :
“Province” means the North Western Province of the Democratic Socialist Republic of Sri Lanka ; and
“Provincial Council ” means the Provincial Council of the North Western Province of the Democratic Socialist Republic of Sri Lanka.

 

Sinhala text to prevail in the event of inconsistency.
5. In the event of any inconsistency between the Sinhala and Tamil texts of this Statute, the Sinhala Text shall prevail.

TRANSFER OF STAMP DUTIES DRAFT STATUTE OF THE NORTH WESTERN PROVINCE

A DRAFT STATUTE TO PROVIDE FOR THE TRANSFER OF STAMP DUTIES COLLECTED UNDER THE FINANCE STATUTE NO. 8 OF 1990 OF THE NORTH WESTERN PROVINCE, TO THE LOCAL AUTHORITIES IN THE NORTH WESTERN PROVINCE

 

BE it passed by the Provincial Council of the North Western Province as follows :-

 

Short Title.
1. This Statute may be cited as the Transfer of Stamp Duties Statute No…………….of 1994 of the North Western Province.

 

Transfer of Stamp Duties.
2. Where the Provincial Council has charged and collected, in terms of the Finance Statute No. 8 of 1990 of the North Western Province, as amended by Statutes No. 2 of 1991, No. 4 of 1991 and No. 1 of 1992 of the North Western Province any Stamp Duty on any instrument relating to a transfer of any immovable property situated within the administrative limits of any local authority in the North Western Province and paid to the Provincial Fund of the North Western Province, the Provincial council may transfer the amount of that Stamp Duty to the local authority within whose administrative limits the immovable property in respect of whose transfer the said Stamp duty was collected is situated, on a claim in writing by the Chief Administrative Officer of that local authority to the Minister of the Board of Minister of the North Western Province in – Charge of the Subject of Finance within a period of five years from the 31st day of December of the year in which the Stamp Duty was collected as aforesaid.

Instruments-

has the same meaning as in the Finance Statute No. 8 of 1990 of the North Western Province ; and

Provincial Council means-

the Provincial Council of North Western Province of the Republic of Sri Lanka.

FINANCE (AMENDMENT) DRAFT STATUTE OF THE NORTH WESTERN PROVINCE

A DRAFT STATUTE TO AMEND THE FINANCE STATUTE NO. 8 OR 1990 OF THE NORTH WESTERN PROVINCE

 

Be it passed by the Provincial Council of the North Western Province as follows:

 

Short Title.
1. This Statute may be cited as the Finance (Amendment) Statute No……………. of 1994 of the North Western Province.

 

Amendment of long title of the Finance Statute No. 8 of 1990 of the N. W. P.
2. The long title of the Finance Statute No. 8 of 1990 of the North Western Province is hereby amended by the deletion of the words “and the Stamp Duty Act, No. 43 of 1982 as amended” thereof and the insertion of the following therefor :-

 

“The Stamp Duty Act, No. 43 of 1982 as amended, the Excise Ordinance, as amended, the Municipal Councils Ordinance, as amended the Urban Councils Ordinance, as amended and the Pradeshiya Sabhas Act, No. 15 of 1987.”

 

Amendment of Section 34 of Finance Statute No. 8 of 1990.
3. Section 34 of the Finance Statute No. 8 of 1990of the North Western Province is hereby amended by the deletion of the words “Five Thousand” occuring immediately after the word “Rupees” in the Paragraph immediately following subsection (0 of the finance statute No. 08 of 1990 of the North Western Province and Substitution of the words “Five Thousand” therefor.

4.In the event of an inconsistency between the Sinhala and Tamil texts of this Statute, the Sinhala text shall prevail.
