Widowers And Orphans Pension (Amendment)
AN ACT TO AMEND THE WIDOWERS AND ORPHANS PENSION ACT, NO. 24 OF 1983

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows;

Short title.

1. This Act may be cited as the Widowers and Orphans Pension (Amendment) Act, No. 19 of 1985.

Amendment of section 3 of Act No. 24 of 1983.

2. Section 3 of the Widowers and Orphans Pension Act, No. 24 of 1983, (hereinafter referred to as the” principal enactment “) is hereby amended by the repeal of sub section (6) of that section and the substitution therefor of the following subsection : –

” (6) Every officer shall, within a period of one year from the date of coming into operation of this section, elect to be a contributor to the pension scheme. Where such officer has died prior to the coming into operation of this section or dies before the expiry of the period within which she could have elected to be a contributor, she shall, if she leaves a husband or child or a husband and child or a husband and children, be deemed to ha e elected to be a contributor to the pension scheme.”.

Refund of contribution to officer who withdraws from being a contributor.

3. Notwithstanding anything to the contrary in the principal enactment, any officer who has elected to be a contributor to the pension scheme established under the principal enactment prior to the date of coming into operation of this Act and from whose salary deductions referred to in section 3 of the principal enactment have been made, may within a period of one year from the date of coming into operation of this Act, withdraw from being a contributor and she shall be entitled to a refund of the entirety of her contributions without interest and upon refund of such contributions such contributor or any person claiming through or under her shall cease to be entitled to any benefit under the principal enactment.
